Master privacy policy, 1. introduction.

1.1. Manex Power and Marine (Pty) Ltd ("Manex", "we", "us", "our") strive to ensure that our use of the Personal Information of data subjects is lawful, reasonable, and relevant to our business activities, with the ultimate goal of improving your experience as a prospective or existing customer, Service Provider or employee of Manex.

3.1. We offer (among others) the following services (“our Services”):

3.1.1. marine, diving and boating-related products and services;

3.2. We collect Personal Information about you when you:

3.2.1. contract with us for our Services;

3.2.2. book or inquire about any of our Services;

3.2.3. access our Website, mobile applications or related software systems;

3.2.4. contact us, or otherwise interact with us; and/or

3.2.5. join Manex as an agent, broker, sales associate, or employee.

4. WHO DOES THIS PRIVACY POLICY COVER

4.1. This Privacy Policy explains how we will treat your Personal Information whether provided by you to us or collected by us through other means in your ordinary use of our Services, and our Website. This Privacy Policy describes our approach and practices in respect of your Personal Information and our treatment thereof.

4.2. This Policy applies to all external parties with whom we interact, including but not limited to:

4.2.1. applicants, individual customers, potential customers and recipients of our Services (including individuals who book or enquire about our Services with or through us or who are the recipients of any Services booked with or through us);

4.2.2. representatives of customer organisations;

4.2.3. individuals whose Personal Information is collected from other companies in our Group (such as where you have consented to your Personal Information being disclosed to other group companies for marketing purposes);

4.2.4. our suppliers and service providers;

4.2.5. visitors to our offices;

4.2.6. other users of our Services.

4.3. This Privacy Policy must be read together with our Website terms and conditions and any other documents, agreements or privacy notices that describe how we, in specific circumstances, collect or process Personal Information about you. This will enable you to understand how Manex will process your Personal Information.

4.4. This Privacy Policy supplements such other documents and agreements, but shall not supersede them and in the event of a conflict, the terms of the particular document or agreement will prevail.

5. YOUR CONSENT

5.1. By providing us with your Personal Information, you:

5.1.1. agree to this Privacy Policy and authorise us to process such information as set out herein; and

5.1.2. authorise Manex, our Associates, our Service Providers and other third parties to Process your Personal Information for the purposes stated in this Privacy Policy.

6. WHAT PERSONAL INFORMATION DO WE COLLECT?

6.1. We may collect, acquire, receive, record, organise, collate, store, update, change, retrieve, read, process, analyse, use and share your Personal Information in the manner as set out in this Privacy Policy. When we perform one or more of these actions, we are "Processing" your Personal Information.

6.2. “Personal Information" refers to private information about an identifiable living natural or juristic person. Personal Information does not include information that does not identify a person or anonymized information.

6.3. The Personal Information we collect may differ according to the Services you receive from Manex. We may process various categories of Personal Information, such as:

6.3.1. Identity Information, when interacting with us as a customer, including information concerning your name, company name, identity and registration numbers, title, physical address;

6.3.2. Contact Information, which includes your billing address, service addresses, physical address, email address and telephone numbers;

6.3.3. Credit Information, to assess our transactional risk and your creditworthiness, including credit history reports from credit bureaus (with your consent where required by law);

6.3.4. Criminal behaviour history, where permitted in respect of prospective employees and job applicants;

6.3.5. Financial Information, where permitted, including bank account details, bank statements and financial statements;

6.3.6. Human Resources in respect of our own employees, including leave records, job applications, medical aid information to administer employment contracts and comply with our legal obligations;

6.3.7. Tax Information where permitted, which includes IRP5 records, PAYE records and VAT registration numbers;

6.3.8. Technical Information, which includes your internet protocol (IP) address, browser type and version, time zone setting and location, operating system and platform, on the devices you use to access our Website, products or Services.

6.3.9. Transaction Details concerning you as an individual, which includes your name, address, telephone, mobile, fax, e-mail, contact details, proof of identity and address, financial information, and any other information provided to us by or in relation to you which concern you as an individual.

6.3.10. Business-related information, if you are an individual associated with a business or other organisation that is our customer, then your Personal Information may include the following information that we link to you:

business or organisation details (such as name, address, telephone numbers, payment arrangements, financial information, etc.)

your relationship with that business or organisation (such as owner, partner, director, shareholder, employee, or agent);

your contact details within that business (such as work address, work telephone and mobile numbers, work fax number, and work e-mail address.

6.3.11. Correspondence, including messages between you and us, and between us and third parties, including correspondence relating to any enquiry, or performance of any contract.

6.3.12. Competition information, including Personal Information collected during any competitions or promotions held by us or our agents or associates.

6.3.13. Usage Information, which includes information as to your access to and use of our Website, products and Services.

6.3.14. Marketing and Communications Information, which includes your preferences in respect of receiving marketing information from us and your communication preferences.

6.4. We also process, collect, store and/or use aggregated data, which may include historical or statistical data (“Aggregated Data”) for any purpose. Aggregated Data is not considered Personal Information as this data does not directly or indirectly reveal your identity. However, if we combine or connect Aggregated Data with your Personal Information in a manner that can identify you, we will treat the combined data as Personal Information, which will be managed per this Privacy Policy.

7. SPECIAL PERSONAL INFORMATION

7.1. Where we need to process your Special Personal Information, we will do so in the ordinary course of our business, for a legitimate purpose, and per applicable laws.

8. HOW WE COLLECT PERSONAL INFORMATION?

8.1. You directly provide Manex with most of the Personal Information we process. We collect and process Personal Information in the following ways, namely:

8.1.1. through direct or active interactions with you;

8.1.2. through passive or automated collections;

8.1.3. in the course of providing our Services to you or your organisation, including where you register as a customer to use any of our Services or you opt-in to receiving any direct marketing from us;

8.1.4. in evaluating job applicants and onboarding Employees;

8.1.5. from third parties, where permitted.

8.2. Direct or active collection

8.2.1. We may require that you submit certain information to enable you to access portions of our Website, to make use of our Services, to facilitate the negotiation and conclusion of an agreement with us, or that is necessary for our compliance with our statutory, professional or regulatory obligations.

8.2.2. We also collect Personal Information when you communicate directly with us. For example:

(a) Via email, meetings and telephone calls;

(b) When you fill in forms or registers, or make a purchase with us;

(c) When you voluntarily complete a customer survey, provide feedback or ask for marketing information to be sent to you.

8.2.3. If you contact us, we reserve the right to retain a record of that correspondence or telephone call, which may include Personal Information.

8.2.4. The Personal Information we collect from you may include any of the categories listed in the paragraph above depending on what will be necessary to perform the Services.

8.3. Passive (automated) collection

8.3.1. We may passively collect certain categories of your Personal Information from the devices that you use to access and navigate our Website or to make use of our Services (“Access Devices”) using server logs and your browser’s cookies.

8.3.2. The categories of Personal Information we passively collect from your Access Device may include your:

a) Technical Information;

b) Usage Information; and/or

c) Any other Personal Information which you expressly permit us, from time to time, to passively collect from your Access Device.

8.4. Indirect collection (from third parties)

8.4.1. We may also receive your Personal Information indirectly from, among others, the following sources (including public parties):

a) our information technology suppliers;

b) law enforcement;

c) credit bureaus (with your consent, where required by law).

d) from other Responsible Parties where we act as contracted outsourced processors (“Operators”) in performing our Services, including:

Banks and other financial institutions;

Telecommunications providers;

8.4.2. When we collect your Personal Information from third parties it is either because you have given us express consent to do so, your consent was implied by your actions, or because you provided consent, either explicit or implicit, to the third party that provided this information to us.

9. HOW WE USE YOUR PERSONAL INFORMATION

9.1. We Process your Personal Information in the ordinary course of the business of providing our Services.

9.2. We also use the Personal Information we collect to maintain and improve our Website and to improve the experience of its users, to facilitate the provision of our Services to you, and to comply with our statutory and regulatory obligations.

9.3. We use your Personal Information only for the purpose for which it was originally collected by the relevant Responsible Party and strictly in accordance with their instructions. We only use your Personal Information for a secondary purpose only if such a purpose constitutes a legitimate interest and is closely related to the original purpose and instructions for which the Personal Information was collected.

9.4. We may process your Personal Information during the course of various activities, including but not limited to, the following:

9.4.1. providing our Services at your request;

9.4.2. processing, collecting and administering payments for our Services rendered;

9.4.3. providing customer support and responding to and communicating with you about your requests, questions and;

9.4.4. transfer of limited and necessary information to our Service Providers and other third parties where required to perform our obligations to you;

9.4.5. with your consent (where required by law), for relationship management and marketing purposes in relation to our Services, including, but not limited to, the development and improvement of our Services, marketing activities (promotions and special offerings), and for accounts management to establish, maintain and/or improve our relationship with you;

9.4.6. to keep internal records and maintain reasonable archives, including enquiries, bookings, contracts, travel services, and complaints;

9.4.7. to carry out direct marketing to you (see Direct Marketing section below for further information);

9.4.8. to detect, prevent, manage and protect against actual or alleged fraud, security breaches, misuse, and other prohibited or illegal activity, claims and other liabilities;

9.4.9. to protect our rights in any litigation that may involve you;

9.4.10. to comply with our regulatory reporting obligations, including submissions to the South African Reserve Bank, Financial Intelligence Centre, South African Revenue Services, Information Regulator and/or other authorities;

9.4.11. for other lawful and legitimate purposes that are relevant to our business operations or regulatory functions. 

9.4.12. conduct our recruitment and hiring process, which includes, referrals, capturing job applicant’s details and providing status updates to job applicants to protect our legitimate interest in ensuring a safe working environment.

9.4.13. operate, evaluate and improve our business units, including:

(a) developing new products and services;

(b) managing our communications;

(c) determining the effectiveness of our sales, marketing and advertising;

(d) analysing and enhancing our products, Services, websites and apps;

(e) maintaining the safety, security and integrity of our Website, products and Services, databases, networks and other technology assets, and business;

(f) performing accounting, auditing, invoicing, procurement, reconciliation and collection activities; and

(g) improving and maintaining the quality of our customer service;

9.4.14. for the purpose otherwise described to you when collecting your Personal Information, or as otherwise outlined in POPIA.

9.5. Manex will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

10. DIRECT MARKETING (ELECTRONIC)

10.1. Manex would like to send you information about our product and service offerings we believe may be of interest to you.

10.2. We may send marketing materials to our customers’ email addresses (including individuals who book or enquire about our Services with or through us or who are the recipients of any Services booked with or through us) as permitted by POPIA, provided that:

10.2.1. your name and contact details were obtained in the context of the sale of our products or Services (including any inquiries, requests or bookings concerning our products and Services);

10.2.2. we contact you to market our similar products or Services.

10.2.3. you may opt-out at any time and free of charge on any of our marketing communications or by emailing [email protected].

10.3. If you are not our customer, we may send marketing materials to where you give us your express “opt-in” consent (either digitally or in-person) to send you marketing materials through your preferred electronic channels of communication, provided that we shall keep a record of your consent and you may opt-out any time and free of charge on any of our subsequent marketing communications.

10.4. Once you have chosen to opt-out, we may send you written confirmation of receipt of your opt-out request (which may be in electronic form), and we will thereafter not send any further direct marketing communication to you. However, you may continue to receive communication from us on matters of a regulatory nature, which are not marketing related.

11. LEGAL BASIS FOR COLLECTING AND PROCESSING INFORMATION

11.1. We will only collect and process your Personal Information where:

11.1.1. You have provided us with your consent (as permitted by law);

11.1.2. To perform in terms of a contract with you;

11.1.3. To protect your legitimate interests;

11.1.4. To pursue our legitimate interests and our customers’ legitimate interests which include:

(a) providing Services to and managing our relationship with existing customers;

(b) fraud and financial crime detection and prevention;

(c) information, system, network, and cybersecurity;

(d) general corporate operations, due diligence and risk assessment;

(e) complying with a legal obligation, and/or enforcing and defending legal claims.

12. COMPULSORY PERSONAL INFORMATION AND CONSEQUENCES OF NOT SHARING WITH US

12.1. Where we are required to process certain Personal Information by law, or in terms of a contract that we have entered into with you, and you fail to provide such Personal Information when requested to do so, we may be unable to perform in terms of the contract in place or are trying to enter into with you. In such a case, we may be required to terminate the contract and/or relationship with you, upon due notice to you, which termination shall be done in accordance with the terms of that contract and any applicable legislation.

13. DISCLOSURE OF PERSONAL INFORMATION

13.1. We will not intentionally disclose your Personal Information, whether for commercial gain or otherwise, other than with your permission or in accordance with this Privacy Policy.

13.2. We may disclose your Personal Information to our contracted Responsible Parties, Service Providers and Associates for legitimate business purposes, in accordance with applicable law and subject to applicable professional and regulatory requirements regarding confidentiality and appropriate data protection measures.

13.3. In addition, may disclose your Personal Information:

13.3.1. where it is necessary for the purposes of, or in connection with, actual or threatened legal proceedings or establishment, exercise or defence of legal rights;

13.3.2. With our contracted agents, advisers, auditors, consultants, service providers, suppliers, banking partners and other Operators who process Personal Information on our behalf and whose assistance we require to conduct our business operations and that:

(a) have agreed to be bound by this Privacy Policy and our Data Protection Policy or by similar terms offering a similar level of protection;

(b) where such Personal Information is necessary for the performance of their obligations to or on behalf of Manex (i.e., records storage, payroll, server hosts); and

(c) based on our instructions, are not authorised by us to use or disclose the information except as strictly necessary to perform the services on our behalf as instructed or to comply with legal requirements.

13.3.3. With third party Operators to the extent that they require such specific Personal Information in the provision of services for or to us, which include hosting, development and administration, technical support and other support services relating to our Website and/or the operation of our business divisions. We will only authorise the processing of any Personal Information by a third-party Operator on our behalf by, among others, entering into agreements with those third parties governing our relationship with them and highlighting instructions, confidentiality, security and non-disclosure obligations.

13.3.4. to enable us to enforce, implement, or apply any other contract between you and us, or any contract where we act as an agent of the principal contracted with you;

13.3.5. to mitigate any actual or reasonably perceived risk to us, our customers, employees, contractors, agents, brokers or any other third party;

13.3.6. to any relevant third party acquirer(s), in the event that we sell or transfer all or any portion of our business or assets (including, but not limited to, in the event of a reorganization, dissolution or liquidation);

13.3.7. With governmental agencies, exchanges and other regulatory or self-regulatory bodies, if required to do so by law or there is a reasonable belief that such is necessary for:

(a) compliance with the law or with any legal process;

(b) the protection and defence of the rights, property or safety of Manex, our customers, employees, contractors, suppliers, service providers, agents, brokers or any third party;

(c) the detection, prevention and management of actual or alleged fraud, security breaches, technical issues, or the misuse or unauthorised use of the Website and any other contravention of this Privacy Policy;

(d) the protection of the rights, property or safety of members of the public (if you provide false or deceptive information or make misrepresentations, we may proactively disclose such information to appropriate regulatory bodies).

13.4. While providing our Services we may obtain, use, and disclose Personal Information about our customer’s customers. In these instances, we process the Personal Information in accordance with this Privacy Policy unless specifically agreed otherwise with our customer.

13.5. Travel Insurance

13.5.1. If any application is made through us to pass onto the Insurers, for any travel or other insurance to cover you, we will pass your Personal Information on to the insurer.  Information provided by you may be put on to a register of claims and shared with other insurers to prevent fraudulent claims.

14. STORAGE AND TRANSFER OF PERSONAL INFORMATION

14.1. We have engaged reputable and trusted organisations as outsourced processors (Operators), and in some cases, as sub-processors to provide data storage and cloud services to securely store your information. Our servers and cloud storage run in secure premises located in South Africa.

14.2. We reserve the right to generally transfer to and/or store your Personal Information on servers in a jurisdiction other than where it was collected, or outside of South Africa in a jurisdiction that may not have comparable data protection legislation; Provided that if the location does not have substantially similar laws to those of South Africa, we will take reasonably practicable steps, including the imposing of suitable contractual terms to ensure that your Personal Information is adequately protected in that jurisdiction.

15. SECURITY AND INTEGRITY

15.1. We take all reasonable technical and organisational measures to secure the integrity of retained information and protect it from misuse, loss, alteration, and destruction through the use of accepted technological standards that prevent unauthorised access to or disclosure of your Personal Information. Unfortunately, despite our best efforts, no data transmission or storage can be guaranteed to be 100% secure. Therefore, we do not make any warranties or guarantees that content shall be entirely 100% secure nor do we accept any liability of whatsoever nature for loss of privacy resulting from any unauthorised disclosure and/or use of your Personal Information, unless such disclosure and/or misuse is because of our gross negligence. However, we are subject to the Protection of Personal Information Act 4 of 2013, which we comply with.

15.2. Our servers are protected by firewalls and access to Personal Information is limited to minimal authorised personnel of Manex. The security of our Website and IT systems is also tested regularly, and every effort is made to ensure that security is at an optimum level at all times.

15.3. When processing payment card details, we comply with the applicable Payment Card Industry Data Security Standard (PCI-DSS standard).

15.4. We periodically review our Personal Information collection, storage and processing practices, including physical and digital security measures.

15.5. We have established and implemented data breach management procedures to address actual and suspected data breaches and will notify you and the relevant regulatory authorities of breaches where we are legally required to do so and within the period in which such notification is necessary.

16. RETENTION AND DELETION

16.1. We may retain and process some or all of your Personal Information if and for as long as:

16.1.1. we are required or permitted by law, or contract with you, to do so;

16.1.2. it is for lawful purposes that are related to our performance of our obligations and activities; or

16.1.3. you agree to us retaining it for a specified further period.

16.2. Unless there is a lawful purpose for us to continue processing or storing your Personal Information, we will destroy your Personal Information in the following circumstances:

16.2.1. the Personal Information is no longer necessary for the purpose for which it was collected or processed; or

16.2.2. you withdraw your consent to the processing of your Personal Information; or

16.2.3. you object to the processing of your Personal Information; and

16.2.4. there are no other lawful grounds for us to continue processing your Personal Information.

16.3. We determine the appropriate retention period for Personal Information by considering, among other things, the nature and sensitivity of the Personal Information, the potential risks or harm that may result from its unauthorised use or disclosure, the purposes for which we process it and whether those purposes may be achieved through other means. We will always comply with applicable legal, regulatory, tax, accounting, labour, or other requirements as they apply to the retention of Personal Information.

16.4. We will destroy your data using effective methods including, among others, shredding.

17. MAINTENANCE, CORRECTIONS AND ACCESS

17.1. We are required to take all necessary steps to ensure that your Personal Information is accurate, complete, not misleading and up to date.

17.2. Anyone about whom we maintain Personal Information may request to inspect and, if appropriate, correct the Personal Information held by us. It is your responsibility to inform us, or the persons responsible for the maintenance of your Personal Information, should your Personal Information be incorrect, incomplete, misleading or out-of-date by notifying us at contact details in paragraph 2.1 above. We may require additional information from the requesting party to assure itself of the legitimate basis for the request and the identity and authority of the requestor. Upon receipt and verification of the corrected Personal Information, we will adjust our data or records accordingly.

17.3. A request for correction/deletion of Personal Information or destruction/deletion of a record of Personal Information must be submitted using the prescribed Form 2 which is available in our Promotion of Access to Information Manual and the Information Regulator’s website.

18. DATA MINIMISATION

18.1. We have service level agreements with third parties who send us Personal Information (either in our capacity as a Responsible Party or Operator). These state that only relevant and necessary information is to be provided as it relates to the processing activity we are carrying out.

18.2. We have destruction procedures in place where a data subject or third party provides us with Personal Information that is surplus to our requirements.

19. YOUR DATA PROTECTION RIGHTS

19.1. Data protection laws may grant you, among others, the following rights:

19.1.1. Request access to your Personal Information – enabling you to receive a copy of the Personal Information retained about you;

19.1.2. Request the correction of your Personal Information – to ensure any incomplete or inaccurate Personal Information is corrected;

19.1.3. Request erasure of your Personal Information – where there is no lawful basis for the retention or continued processing of your Personal Information;

19.1.4. Object to the processing of your Personal Information for a legitimate interest (or those of a third party) - under certain conditions where you feel it impacts your fundamental rights and freedoms;

24. GOVERNING LAW

24.1. This Privacy Policy is governed by South African law.

24.2. If any provision of this Privacy Policy is determined to be illegal, void or unenforceable due to applicable law or by order of a court, it shall be deemed to be deleted and the continuation in full force and effect of the remaining provisions shall not be prejudiced.

Heat mapping and session recording

Heat mapping services are used to display the areas of www.manex.co.za that Users interact with most frequently. This shows where the points of interest are. These services make it possible to monitor and analyse web traffic and keep track of User behaviour.

Some of these services may record sessions and make them available for later visual playback.

How to manage preferences and provide or withdraw consent

There are various ways to manage Tracker related preferences and to provide and withdraw consent, where relevant:

When Trent and Tynan flew to Cape Town in 2021 to do the handover of our Leopard 45 they didn't expect to end up spending 7 months there working on the yacht. One of the challenges of doing boat work in Cape Town is finding out where the high quality, reliable or well stocked suppliers, importers and contractors are.

 Based on their experiences, here are 17 places Trent and Tynan managed to source yacht related supplies, tools and contractors from in Cape Town, South Africa.

Our recommendation for Leopard Aftermarket in Cape Town only applies to working with with Marcel Van Rooyen. He has excellent customer service and understands and cares about the quality of work being done on customers yachts.

Unfortunately, many of the contractors in Cape Town don't understand the challenging and remote environments these yachts can travel to. Marcel does. He is one of the few entities in South Africa that will provide support and peace of mind once you leave Cape Town.

One of the main yacht part and marine equipment importers in Cape Town, Manex will generally offer you a better deal on the products they supply other stores.

9. Viking Life-Saving Equipment

This is the importer for the ACR safety equipment in Cape Town so is the place to go if you want a good price on your EPIRB. Keep in mind that if your MMSI hasn't been issued it's best to wait until you have one before purchasing the EPIRB. Free programming can only be done at the place of purchase so you can't buy it from Viking and have it programmed at another ACR dealer free of charge.

Southern Ropes are the rope supplier for many of the yacht manufacturers in Cape Town, including Robertson & Caine / Leopard Catamarans (when we were there). You can learn more about the rope they produce on their  website .

Our focus when visiting Maizey was just plastic boards as we wanted some huge custom chopping boards for fishing, but as you can see on their  website  they do offer more than that.

16. Builders Warehouse

Builders Warehouse is a big box style hardware store like Bunnings, Lowes or Bauhaus. Unfortunately it was undergoing renovations for most of the time that we were in Cape Town so it's not somewhere we personally were able to use, but it's somewhere we'd have looked to find general items if we couldn't find them at one of the specialty stores. Action Yachting is a full service repair yard and chandlery shop situated on the premises at the Royal Cape Yacht Club. Established in 1987, we service the greater Cape Town yachting community, as well as many visiting yachts from other parts of South Africa. We also provide a vital repair and parts procurement service for the numerous foreign cruising boats that pass through Cape Town every year.

Update: Fifth body recovered from yacht wreck, confirmed death toll now six

Fifth body recovered from yacht wreck

Update, 22 August, 10:30am:

A fifth body has been retrieved from the wreckage of the yacht, as confirmed by the civil protection authority, Cape {town} Etc reports. 

This latest recovery brings the total number of confirmed fatalities to six, following the discovery of Chef Recaldo Thomas’s body on the day the yacht sank.

Early in the morning, just after 9:45am, a fire service boat with flashing blue lights returned to Porticello, carrying a blue body bag.

Among the survivors were two young South African hostesses who have recounted the terror they felt as they were caught in the fierce storm.

South Africans Leah Randall (20) and Katja Chicken (22) are currently staying at a hotel in Sicily alongside other survivors.

They were seen in the lobby of the Domina Zagarella hotel in Santa Flavia, which has also become a temporary base for police and rescue teams.

The hostesses expressed their disbelief at surviving, saying, ‘We are alive by a miracle.’

Their voices trembled with emotion, and they were unable to provide more details, still overwhelmed by the trauma of the event. One of them added, ‘It was terrible.’

The survivors did not share further information about their rescue.

Update, 21 August:

Specialist divers are still searching for six individuals who were aboard the luxury superyacht Bayesian, which capsized off the coast of Sicily on Monday morning.

The cause of the vessel’s sinking remains under investigation. Vessel tracking data indicates that the yacht departed from Milazzo on 14 August and was last recorded east of Palermo with its navigation status listed as at anchor.

Initial reports suggest that a tornado, or waterspout, may have struck the yacht, leading to its capsizing. Another theory is that water may have entered the boat through open hatches and doors, left ajar due to the warm weather along the Italian coast.

According to sailing expert Sam Jefferson, the open hatches could have allowed water to flood the yacht quickly, especially after the vessel was tipped over by strong winds. He notes that the mast, being very large, might have acted like a sail, exacerbating the boat’s tipping.

Witnesses observed a waterspout forming before the yacht’s sinking. Waterspouts, similar to tornadoes but over water, are short-lived and not easily detected by weather radars. The International Centre for Waterspout Research confirmed 18 waterspouts off Italy’s coast on 19 August. With rising sea temperatures due to climate change, such phenomena might become more frequent. The Mediterranean recently recorded its highest sea surface temperatures, fueling storms.

Bayesian, built by Perini in 2008 and last refitted in 2020, features a 75-metre (246-foot) mast, which may have contributed to the vessel’s instability. Captain Karsten Borner, who was nearby, reported a powerful hurricane gust and saw the yacht’s mast bend and snap.

Despite these reports, Palermo fire service diver Marco Tilotta confirmed that the yacht remains largely intact but on its side.

Matthew Schanck from the Maritime Search and Rescue Council noted that it’s difficult to confirm if the mast broke. He considers the incident a ‘freak event,’ emphasising that yachts are not designed to withstand tornadoes or waterspouts.

Since mid-June, sea temperatures around Sicily have been exceptionally high, with recent records indicating water temperatures exceeding 30°C (86°F). This extreme heat, attributed to climate change, has contributed to the unprecedented conditions in the Mediterranean. Scientists warn that the oceans, absorbing much of the excess heat, are warming more rapidly than expected, raising concerns about future climate impacts.

A luxury yacht sunk during a tornado caused by a freak storm off the coast of Sicily. A search and rescue operation is currently underway and reports have confirmed one fatality and six missing passengers, Cape {town} Etc  reports.

Of the wreck, 15 people have been rescued, with eight of those passengers being hospitalised.

All eight were in stable condition, which included a one-year-old baby, according to 2oceansvibe .

The yacht, named the Bayesian , was caught in the storm when a tornado hit the area, located off the coast of Porticello, near Palermo, at around 5am yesterday.

Reports indicate that the yacht’s passengers were tourists on holiday in Sicily, and it is feared that those missing may have been ‘trapped inside their cabins’.

A helicopter and coastguard ships have been sent to search the wreck above the surface as well as below. Divers already reached the hull, located 500 metres from the coast and 49 metres below the surface.

Divers saw ‘corpses through the portholes’ of the sunken ship as the body of a man was being recovered at a depth of around 50 metres.

The body recovered is believed to be that of Recaldo Thomas, the vessel’s Canadian chef, according to Sky News .

Based on nautical map information, the Bayesian was at anchor soon after 2am local time.

It has been theorised that the ship made a stop at Milazzo, around 160 kilometres up the coast in the direction of the Italian mainland, before it sailed on to Porticello.

Witnesses told the Italian news agency ANSA that the ship was still anchored close to the port when the tornado hit.

‘That boat was all lit up,’ a witness in Porticello told ANSA .

‘At around 4.30 in the morning it was gone. A beautiful boat where there had been a party. A normal holiday spent happily at sea turned into a tragedy […] The boat was not far from the port. It took very little to raise the anchor and head for the port. Evidently, they were surprised by the storm that suddenly hit and they were unable to avoid sinking,’ the witness added.

Among the missing passengers was tech entrepreneur Mike Lynch, who has regularly been described as ‘Britain’s Bill Gates’, according to NBC News .

Lynch (59) is the founder of the enterprise software firm Autonomy and became the target of a ‘protracted legal battle’ with Hewlett Packard after the US tech giant accused him of ‘inflating the company’s value’ in an $11 billion sale.

Extradited from Britain to the US last year to stand trial, Lynch was acquitted of fraud following a three-month trial.

Lynch’s 18-year-old daughter is also among the missing, BBC News reports, while other high profile passengers that remain missing are  Jonathan Bloomer, chairman of Morgan Stanley International, and Chris Morvillo, a lawyer at major firm Clifford Chance.

Lynch’s wife, Angela Baracas, was among the 14 other survivors.

‘They were in the wrong place at the wrong time,’ said Salvo Cocina of Sicily’s civil protection agency.

Cocina noted that another superyacht nearby wasn’t as badly damaged and helped rescue some of the 15 survivors. AP reported.

In a statement, Italy’s coast guard said that the 184-foot yacht sank ‘due to a violent storm’, off the coast of Palermo, at around 5am local time, with 22 people on board.

American, British and Canadian citizens were among those missing, the statement added.

Karsten Borner, the captain of the ship that rescued the survivors, told reporters that there was a ‘strong hurricane gust and we had to start the engine to keep the ship in an angled position’.

Borner added that they had seen the Bayesian behind them during the storm, and said that after the storm subsided, they ‘noticed that the ship behind us was gone,’ Borner added.

‘Fifteen people inside. Four people were injured, three heavily injured and we brought them to our ship,’ said Borner.

‘Then we communicated with the coast guard and after some time, the coast guard came and later picked up injured people,’ Borner added.

The UK-registered Bayesian , built by Italian shipbuilder Perini in 2008, has an aluminium hull and can carry 12 guests and a crew of up to 10.

The boat left the Sicilian port of Milazzo on Wednesday, 14 August and was last tracked east of Palermo on Sunday evening, with a navigation status of ‘at anchor’.

Lagoon 60 : Double the pleasure

Lagoon catamarans is without doubt the biggest cruising multihull manufacturer in the world and their yachts are ubiquitous be it in the South Seas or the South Coast of England. The manufacturer states that there are around 7,000 Lagoons bobbing around on the oceans. The secret of their success could probably best pinned on their consistency of purpose; the Bordeaux based manufacturer has never really tried to produce anything other than comfortable cruising catamarans. Sure, they have always looked to improve performance and internal volumes but they have always kept the faith with the idea that they know what they want to produce and they believe that they are in tune with the buying public. The results speak for themselves; nobody is ever going to win races in a Lagoon but they will always have a comfortable platform for cruising adventures and the fact that you find Lagoons the world over suggests that the boats are tried and tested in quite extreme conditions.

Having said that Lagoon has always displayed a consistency of purpose is true but its also fair to say that they have diversified slightly in recent years. The introduction of the spin off Excess range of slightly more sporty cruising cats spoke of a desire to diversify slightly. Meanwhile, the launch of the Lagoon Sixty 5 and Seventy 7, big cats aimed squarely at a slightly more bling audience than smaller models, also pointed to a desire to move into a new market, one remove from their previous flagship, the Lagoon 55. The 60, which replaces their bestselling 620, is a clear attempt to bridge the gap between the 55 and the Sixty 5 and there is plenty of evidence that they have looked to take the best aspects of both these boats and fuse them in the new 60. This is a yacht that shares plenty of styling and design characteristics with the 55 and its smaller sister the 51 yet, once aboard, I definitely felt that it shared a lot with the luxurious Sixty 5 when it came to the interior space.

So who is the boat designed for? Well, while the 55 is mainly aimed at cruising couples, Lagoon accepts that the 60 will likely need a full time crew. Sure, the set up is simple enough to sail as an energetic couple but this is a genuinely big boat and that means an awful lot of cleaning if nothing else. The boat is designed by VPLP with Nauta doing the interior. This is a classic team for Lagoon and they rarely make too many mis steps. The design is far from radical and features hulls designed for volume and also taking into consideration that this is a yacht that is likely to be loaded to the gills. Lagoon is realistic enough to know that they are not going for blinding performance with this boat so daggerboards are out of the question and the tulip shaped midship sections ensure that there is big outward flare well above the waterline to boost volume. The boat relies on stub keels which give a draught of 1.6m to give a bit of grip going to windward but she is not going to compete with the Catanas or Outremers of this world – nor is she intended to. Given that this is a yacht that weighs in at 32,000kg it is perhaps no surprise that the sail area is big, with an air draft of 100’ meaning that, even with the flybridge reducing the size of the main somewhat, this is a big rig. As with the 55, the rig is stepped further forward than on earlier models and is fitted with overlapping headsails. Naval architect VPLP says these offer more flexibility and efficiency on a boat of this type than the near ubiquitous non-overlapping jibs of today’s yachts.

Approaching the boat from the water (she was anchored off the port of Fornells in Minorca when I tested her) I was struck by the strong family resemblance with the 55. Stepping aboard though and I felt like I’d moved into an altogether different size bracket. Make no mistake, this is a big boat. Approaching from astern you have wide bathing platforms on the sponsons and two steps up take you to the cockpit. A notable feature is the dinghy/bathing platform which is a massive wood slatted platform that drops down to water level when at anchor and can be submerged to allow the dinghy to float free. At deck level there are two side flaps on both quarters that drop down to give you even more space. This feeling of space is genuinely astonishing by the way – as you can probably imaging given the boat has a beam of 32’.

One notable feature is that the entire boat from stern to bow features no steps up or down. This was more of a challenge for the designers than you imagine and was a conscious decision based on the idea that they wanted the boat to feel as open as possible. It means you have an unobstructed walkway from the back of the aft cockpit, through the saloon to the forward cockpit. The aft cockpit area is big with an L-shaped sofa and twin tables to port. The drop leaf tables fold out to make one very large single table ideal for dining al fresco. To starboard is another sofa with a fridge at the forward end. There is storage both under the seats and under the deck plus access to the engines. There is also direct access to the owners stateroom from the starboard side of the cockpit via a fancy doorway/hatch made from toughened glass.

Two steps up takes you onto the side decks which are wide and feature a good handhold on the coach roof. Up at the bow there is a forward cockpit area with loungers and sofas. This is also a pleasant space and there is a door that leads you straight back into the saloon, so access is excellent. The Solid foredeck does not extend right to the bow, which is reserved for two crew cabins to port and starboard of the trampoline. These feature a reasonable amount of space for crew and the port side has an ensuite with shower.

Heading back into the cockpit and then up to the next level via well proportioned stairs is the flybridge, which is well shaded by a solid bimini. This area is huge, with a work surface, sink and fridge aft and to starboard and l shaped seating area with table to port. The stairs up to this deck are to starboard and the helm is also offset to starboard. Forward of the helm station is a large seating/lounging area with a coffee table in the middle. The solid Bimini has a detachable ladder up to it which gives access to the main and has solar panels on it. There are four giant harken winches with 14 jammers – seven each side – which handle all the running rigging. In addition the buttons for the furling code 0, staysail and Genoa are to port And starboard The helm station is comfortable with a broad seat. 

The saloon is huge and loosely divided into three areas with the galley aft and to port and a small nav station aft to starboard. In fact this galley area is a sink, wine cooler and fridge plus storage space because the actual galley is just aft of this, completely separate, with it’s own entrance in the cockpit. Down here you have a good space for cooking with a huge full height fridge four ring hob and oven plus ample workspace and a small crew dining area. There is an option to expand the galley in the main living area, dispense with the large ‘crew’ galley to starboard and turn this into an extra cabin. This marginally reduces the feeling of space in the saloon but might work better if you had plans to charter the boat out a lot. Staying in the saloon and forward on the port side is a huge seating area with a coffee table in the middle and then a dining area to starboard. It’s all very open with sliding patio doors into the cockpit and a large door leading to the forward cockpit.

Descend to starboard and you are in the owner’s suite. This is huge and very light and spacious. The double bed is athwartships and there is more than enough space to walk either side of the bed and also a desk area forward of this. After is the bathroom which has a totally separate heads and steps aft which, as already mentioned, lead directly onto the aft section of the cockpit. The smoked glass ensures privacy while also letting in masses of natural light. It’s an extraordinary place to take a shower. Staying in the starboard hull and forward of the stateroom –  and completely separate – is a large guest double with ensuite. There’s plentiful room and a good feeling of space.

Stepping into the port hull and moving forward of the galley which we have already discusse, there is a twin bedroom with fore and aft berths plus  ensuite. Ahead of this there is a double cabin with the bed set athwartships forward of this with the ensuite at the bow. The boat therefore sleeps eight comfortably plus the crew up forward. The overall ambience is very pleasant and the quality of the fit out was impressive. Trite as it may be to say, this is far more spacious and comfortable than many mid sized apartments. 

One thing you can’t do with a mid sized apartment is take it sailing. Something you definitely can do with the Lagoon 60. Conditions in Minorca were somewhat tricky for a boat weighing in at 32 tonnes. The wind was between 5 and 10kn, although the water was relatively flat. Under sail the 60 proved a powerful performer in very light winds and with the Code 0 unfurled we were largely able to match the wind speed up to 7kn. Sail handling was simple but the hydraulic steering was a touch on the notchy side and lacking in feel. I’d just come from a week sailing a tiller steered Jeanneau Selection 37 so this was a hard contrast. Although it’s fair to say that the contrast in comfort aboard was similarly striking. Things have improved a lot in a short time when it comes to hydraulic steering but even so, it lacks a bit of feel and on any long passage you’ll be sticking it on autopilot and simply enjoying the ride. The boat is medium displacement and is designed to sail heavily loaded down so that powerful sail plan is a must and it works well. She’s not massively close winded but she does truck along thanks to that big sail plan. Under power she was very responsive and the addition of bow thrusters meant it was supremely easy to manoeuvre. The Raymarine dock assist system further helped ensure that mooring was truly effortless with six cameras allowing you to see clearly all sides of the boat and their distance relative to the quay. 

Sam’s verdict on the Lagoon 60

At the mid point of the test, we anchored up for a couple of hours and enjoyed lunch and a swim. For all the Lagoon 60’s fine sailing I felt it was this that truly showcased the potential of this yacht; its supremely comfortable and large enough to be both a sociable space but also allow you the space to unwind in a quiet corner. As with all Lagoons, you’re not going to win a Transatlantic race, but you’ll get there without any fuss and once you arrive, you’ll have the most comfortable yacht in the anchorage.
