Les saintes.

Is a mind-blowing, dainty archipelago which is home to some of the most beautiful bays in the world. If you are seeking an epic experience here in Les Saintes, hiking up to Fort Josephine would be an excellent first choice. At the summit, you will enjoy a 360 ̊ view over this small group of islands. On clear days you can even see Dominica, Basse-Terre and Marie Galante in the distance. This ancient fort provides spectacular sea views, with cannons facing outwards as if still protecting against invaders from centuries ago. Within the walls of the fort, a wealth of history at the museum. Other highlights of this hike include baby goats and iguanas scampering around enjoying their freedom.

Basse Terre

Sailing across the Canal des Saintes, past Vieux Fort Lighthouse, gives a great perspective of “La Souffrière”, Basse-Terre’s active volcano; witness clouds slowly disperse to reveal an enticing view of the volcano. Snorkelling with turtles in Japanese Garden in Malendure (Reserve Cousteau) also offers a lifelong memory and experience.

Les Bains Thomas is a hot spring area along the coast of Basse-Terre. It’s an excellent place to mix with locals and enjoy natural volcanic minerals, as well as fantastic sunsets on the ocean side of Basse Terre. Watch out for green flashes at sunset. While sipping your sunset cocktails, it’s not uncommon at all to see whales and dolphins not far offshore in large numbers. In fact, it has become quite a common occurrence to be greeted by their majestic beauty. You may also have the privilege of hearing their calls and songs as you snorkel or scuba dive.

Marie Galante

We offer another land excursion in Marie Galante: Visit the “Père Labat” distillery (Still using old machinery) and the “Maison Murat”, which is now a Museum dedicated to the slavery period. Dropping anchor at Grande Anse, allows you to enjoy the very large, desolate, quaint bay, as you blissfully stroll in search of sand dollars or conch shells.

This is a sample itinerary that might be altered by the captain depending on weather factors or guests’ requests.

Check in, drop off your luggage during the day and explore the local marina area before boarding. Upon arrival, enjoy a refreshing welcome cocktail onboard as we depart for our first anchorage, Bane Rose, in the protected Bay of Pointe à Pitre before sunset.

Petit Havre

Following breakfast, the adventure starts. Our first stop will be the small natural harbor of "Petit Havre," where it's time to jump in for some snorkeling before lunch. Afterward, we'll head up to the pretty town of "Sainte Anne," famous for its white sand beach and spectacular handicraft village and spices market. You will enjoy these Caribbean flavors! Then, back on your yacht to enjoy the sunset over "Basse-Terre" while sipping a cocktail.

Marie-Galante

We head out after breakfast in search of dolphins and whales as we make our way to the island of Marie-Galante, named after one of Christopher Columbus' ships. We'll be moored in the stunning bay of "Anse Canot": Snorkeling, diving, kayaking, stand-up paddling, and beachcombing are on the program. Marie-Galante has remained rural and lives in rhythm with sugar cane cultivation. The countryside is covered with ruffled sugar canes with splashes of white. You can frequently come across carts on the roads during harvest time, full of canes pulled along by oxen, on their way to one of the three distilleries: Bielle, Bellevue, or Poisson. We strongly recommend the tour of the distilleries. After you visit the distillery, your boat will be waiting for you with, once again, cocktails & sunset waiting for you onboard...

After a morning swim, we set sail to "Les Saintes". Discovered by Christopher Columbus on "All Saints" Day, this archipelago was the stake of many battles between the French and the English: a strategic site qualified as the "Gibraltar of Guadeloupe". Anchored in this beautiful bay, we can go ashore and discover the little French fishing village of Bourg des Saintes, an adorable seaside town that is sparkling clean and picturesque. Flowers grow in abundance, and no one is in a hurry. A few things to do: Fort Napoleon, Pompiere Beach, and shopping!!

Ilêts Pigeon

Set sail after breakfast towards Ilêts Pigeon, and visit the world-famous "Réserve Cousteau", a diving and snorkeling paradise. On our way, stop in one of the many gorgeous bays for lunch: Anse à la Barque, Les "3 Tortues" or "Anse Bouillante". Once at Ilêts Pigeon, snorkelers and divers prepare for one of the best sites in the Caribbean. Evening on board allows us to review all the fish species encountered during the day...

After breakfast, we sail back to Les Saintes, where we'll moor the yacht for a special day of swimming, snorkeling and scuba diving at 'Pain a Sucre', a 200-foot mini-piton. Here, you will find an exquisite beach with a picturesque abundance of palm trees. The underwater life is bright and colorful. The bay also provides a perfect place to use as a base for those who want to do some land-based exploring. A track leads up to the main road and a nice hike up to "Le Chameau", to the old lookout tower at the top. A small secluded beach is in the other direction, past "Le Bois Joli". If further hikes sound appealing, bring along good shoes and your camera, for the grand views are numerous, breathtaking and well worth recording.

On Departure Day, after a last tasty breakfast on board, it is time to gather your belongings and say goodbye to the crew before arranging transport to the airport. We hope you leave with incredible memories of your week in Guadeloupe.

This very spacious luxury yacht captures, through its design, much of the natural light allowing it to flow through the salon, galley and cabins. The minute you step aboard, you will be amazed at the space allocated to relaxation and enjoyment. The open plan of the salon and cockpit area will give a definite feeling of conviviality when sharing special moments with friends or family. The sliding window next to the sink means meals can be passed directly from the galley to the cockpit, which is ideal as most of the dining aboard Purpose takes place al fresco.

Stepping up to the flybridge, you will get a panoramic, breezy, bird’s eye view of the seascape and with an open-air lounge area located next to the helm, you can also be wonderfully entertained by adventurous stories from your captain when under sail. When at anchor, the sunbathing lounge on the foredeck offers a great, shady, comfortable spot to spend relaxing moments.

Purpose is the Quintet version of the Saba 50 and offers three guest cabins in the port hull and two to starboard. The sixth cabin, a middle starboard cabin, is reserved for the crew. All cabins are en-suite.

A wide glass door separates the outside from the inside, but the two are on the same level so it’s easy to move from the exterior to the interior. Natural light floods through overhead hatches and large windows that you can see out of even when seated.

S/V La Gatta

Mamy Wata means Mother of the Ocean and onboard, you will certainly feel cared  for. As you  step on to the aft deck upon arrival, you will find  yourself in a  spacious area used for relaxing,  sunbathing and outdoor dining. A C-shaped sofa and elevated table are positioned on the port side, while a second sofa for extra guests are located on starboard. There’s a small fridge for drinks, and a bimini canopy that can be lowered to give all-day shade. On the foredeck, there is a lovely space for sunbathing. The aft half contains a deck shower and a swim platform.

The salon is accessed via a central stairway. There you will find a couch/daybed on starboard, a widescreen TV on the aft wall, and a corner sofa with a fold-out table on port side. The galley is located directly behind the dining room and has direct access to it, while the crew quarters are located at the aft of  the vessel.

The lovely light-filled interiors with its gentle colour tones of cream mingled with the natural light wood panelling accentuates the space within. Skylights in the main salon and cabins provide plenty of natural light throughout the day.

S/V Deep Blue

Tahiti: Favorite Charter Yet!

Tahiti is incredible and seeing it by boat will leave you feeling bad for everyone stuck at a resort! This was our third charter with Dream Yacht and we enjoyed an excellent experience during booking, check-in and check-out. The base staff in Raiatea are welcoming, informative and genuinely hustle to get you off the dock. We can't wait to return and explore more of French Polynesia!

10 days on a Bali 4.6 out of Raiatea. Great trip. Loved it. Normally have gone with Moorings/Sunsail, but as of late their prices have gotten excessive so been trying out DYC. This was my second trip with them (first in La Paz) and already booked a trip for 2025 in Greece with DYC because of great experiences. I generally try and go on their Super Premier or Premier boats to reduce chance of age related issues. Specific to Raiatea, French Polynesia - awesome charter. Want to go back! Great folks.

Unforgetable experience in Sardinia

Had an excellent experience since the booking process until the end of the charter. Everything worked well with the boat and skipper. The team was very professional and efficient. That was our first experience abroad and we intend to repeat.

Fabulous family vacation to Tahiti

We had a great family trip to Tahiti ( 6 adults 3 older children) , chartered a 6 cabin catamaran with Captain and Cook. Our Captain was amazing. She asked where we wanted to go, gave suggestions, and then we proceeded to have an amazing week. She took us to some amazing snorkeling spots (black tip sharks, sting rays, beautiful fish) , botanical garden, vanilla plantation, rum distillery and a pearl farm. She was always first and foremost concerned with our safety and comfort. Food was good and plentiful. Catamaran clean and comfortable. We have been on more elegant catamarans but all the above more than made up the difference. My only criticism for Dream Yacht Charter is that they post actual photos of their catamarans on their website. We would not hesitate to book with them in the future. BTW our Captain was Hemanu and Cook Daisy.

Great base, great customer service, proffesional and friendly staff, and most importantly - boats are really well maintained.

We had two great experiences with DYC.

We chartered twice with DYC in Raiatea, French Polynesia. We had a great experience both times. We booked directly with DYC, and not through a third party. Both times they delivered. Also, their insurance policy is great. You can sail more or less wherever your want if you are competent. And they will encourage and help! Dream on in the US or EU! When I read all of the bitter posts, I roll my eyes and think that the usual CYA US attitude is going to destroy the whole industry and then nobody can sail in paradise. At least we still could.

The Dubrovnik base was a great location…

The Dubrovnik base was a great location to start our sailing experience. The DYC team got us out on time as promised and the yacht was as expected. Nothing was missing and the vessel was in great shape! Croatia is the most beautiful place to experience and the many islands we stopped in were a lot of fun and the anchorage’s and moorings were amazing [Hvar, Mljet, Lostovo, and Pelisaic]. Unsafe yacht

I chartered a 52 ft yacht in Antigua and it was unfit for purpose and potentially dangerous. There was an extensive list of faults which ruined our holiday, including a windlass that did not operate, an anchor that did not swivel, reefing lines jammed in the boom and hazardous swim ladder. The yacht also lacked basic appliances, had a hole in the kettle and missing fire extinguishers. This is an accident waiting to happen. I could go on… Dream yachts refused to even acknowledge my emails and sent no apologies. Avoid them at all cost.

Sailing in Palma Mallorca was great. We will go back

Sailing in Palma Mallorca was an absolute delight! The base manager was top-notch, ensuring everything ran smoothly and efficiently. The dock manager's skill and diligence were evident, making the experience even more enjoyable. The location itself was picturesque and offered the perfect backdrop for a fantastic time on the water. I had an amazing experience overall and would highly recommend it to anyone looking for a memorable sailing adventure.

DYC makes it really easy to charter

DYC makes it really easy to charter a bareboat sailing vacation. Having done a dozen trips with the competition in BVI, Bahamas, Greece, Italy, etc I feel more confident in Dream's ability to get you on a high quality boat on time and in good condition. When they missed the boat (pun intended) in one situation, they were also gracious about admitting fault and offering a credit to future trips. I especially want to call out Savannah Collins on the American sales team who was a joy to work with over the phone. Thanks for everything Savannah!

Unfortunately disappointing (Abacos)

Unfortunately our 3rd tour with DYC was disappointing. The captain was disinterested, rude and barely present. The Abacos are still worth seeing - with a different crew. Despite our feedback, Dream Yacht Charter didn't get in touch. Bad customer service for us. We sailed the last time. Well, we hardly sailed.

No Dream in Dream yacht Charter

This was my worst vacation. We bare boated and the boat broke down, for 5 days we were stuck in a marina, while the boat was repaired and DYC has refused to do anything. these additional costs, we didn't plan for, and we lost a huge part of our vacation. before you book with them, try getting a hold of the base in the Bahamas, or a supervisor or someone who deals with complaints or refunds. Aside from sales/customer service (booking) you wont get past the iron curtain!

Horrendous Experience - Took ALL our money and no holiday

Horrendous Experience Dream Yacht Charters cancelled our holiday before the departure date due to Covid—19 lockdown in UK & Greece BUT then refused to return a single penny We lost the entire amount we paid - 100% of the holiday price They just ripped us off They are NOT ABTA either Do NOT use them under any circumstances

Dodging any issues.

We lost one day of our charter due to our freshwater being pumped into the starboard engine bilge whose bilge pump was not working and consequently filled up with water , at one point we thought we were sinking ! We returned to base as we had no water and no way of keeping it in the tanks even if we could have refilled. In another incedent in a torrential downpour a fixed cabin window leaked and destroyed my laptop. The reply from DYC main office was less than helpful. The laptop destruction was our fault as we put it in the wrong place and the lost day was ignored. Be very carefull when dealing with the main office they seem only to want to dodge any issues which involve any sort of refund.

Cabin charter in Corsica South cancelled with no explanation

Booked and paid last May a cruise (cabin charter) in Corsica South for the w/c Aug 7 (2 cabins); two weeks before the start of the vacation (overall 2 weeks with trips to Paris and Bordeaux already booked), my cruise was cancelled for "overbooking". Despite several attempts to get an explanation, an excuse or a counteroffer, no one from both DYC Italy nor DYC.com replied so far (after a month). I'm very very disappointed for this, especially because I was a DYC client since years (5 cruises so far). While I want to thank Mondovela, the Italian DYC agency, for providing me with a backup solution in Sardinia, saving at least partially my summer holidays. P.N.

Very bad experience chapter 2

After having the bad experience described in my post of 04/11/2022 (see below Title "Very bad experience") Dream Yacht Charter asked me filling the form bit.lydreamyacht I filled in the form on 20/11/2022 but I never got a reply... If no compensation is soon accepted, after discussion with a lawyer, I plan a legal action. The complaint will be located in France. I also propose sharing the practical information (submit of a complaint to the court, steps...) for French customers wishing running a legal complaint. References of my contract Booking First 30 in La Rochelle (France) Contract 889258548 sailing trip cancelled April 2022 .

RUN away from DYC

Run, do not walk, away from these people. "Dream" Yacht Charter should be "Nightmare" Yacht Charter. We had the misfortune to give them a deposit for a charter in Tahiti before Covid hit. While other travel industry companies tried to be reasonable, DYC continually tried to squeeze us (like initially demanding full payment far in advance of our charter that never happened.) I understand Covid was hard for everyone, but the way these people jerked us around, changed the rules, made unreasonable demands, is just too much. Eventually my group decided we would rather lose our deposit rather than give these people another dollar of our money. You have been warned.

First experience with DYW and first…

First experience with DYW and first time with DY Croatia. Preparation and briefing with the service team in US was so thorough that when I got to Dubrovnik ACI Marina everything run smoothly. No hidden costs, everything very transparent. We took a skipper who happened to be top notch, a local celebrity. Trip was excellent in all respects but we had little wind and we had to motor most of the time: next time I will make sure we reserve minimum guaranteed winds of 15 knots LOL

Sailboat Chartered in Tortola in Horrible Condition

The captain was great but the boat was in total disrepair. The generator never worked, the toilet either did not work or worked poorly, the furniture down below was taped together with yellow tape, the ladder was dangerous etc. For all the money we spent to rent this boat we should be treated better

Great charter with Dream Yacht in St John

Had a great bareboat charter sailing around St John out of St Thomas with Dream Yacht Charter in a brand new Fountaine Pajot Lucia 40. Thanks to Dawn Fingers and the rest of the team for helping to accommodate our last minute booking. Highlights were Zozo’s at Caneel Bay and Cruz Bay. We’ve booked bareboat charter with Dream Yacht a number of times in the past and have they seem to be the best outfit in terms of boat maintenance and professionalism.

Typical Guadeloupe Itinerary

Day 1: Saturday (Pointe-à-Pitre – Marie Galante) Boarding at Marina Bas du Fort. Departure to Marie Galante – Anse Canot (about 3 hours). Night on board, at anchorage.

Day 2: Sunday (Saint Louis) Breakfast at Anse Canot – Marie-Galante, the island of a hundred mills Lunch on board. Optional Excursion (additional fee): Bus tour of the island in the morning (about 3 hours). Afternoon in Saint Louis.

Day 3: Monday (Petite Terre) After breakfast, departure to Petite Terre (about 3 hours). Tour of the island of Petite Terre which became a National Natural Reserve in 1998. You will be able to swim and snorkel around differents species or visit the exposition room in the lighthouse of the island and walk around the educational trail.

Day 4: Tuesday (Pigeon Islands) After breakfast departure to Pigeon Islands (about 8 hours). Lunch at anchorage, facing the islands. For scuba divers, it’s possible to go scuba diving with local dive centers (additional fee.) Optional Excursion (additional fee): Snorkeling trail tour with local dive centers.

Day 5: Wednesday (Les Saintes) Breakfast then relaxation, free time and nautical activities from the boat, snorkeling. Optional Excursion (additional fee): Botanical road trip with 4×4 to discover the luxuriant flora of Basse Terre Island. After lunch, avigation towards Les Saintes (3 hours).

Day 6: Thursday (Terre de Haut Bay – Îlet Gosier) After breakfast navigation to the Terre de Haut Bay. Anchor in the bay. Optional Excursion (additonal fee): Village tour and walk to the Fort Napoleon. Lunch on board then free time and sail to Îlet Gosier (4 hours).

Day 7: Friday (Pain de Sucre – Îlet Gosier) After breakfast, navigation towards Pain de Sucre anchorage (30 minutes). Relaxation, free time and nautical activities from the boat. Lunch on board then return to Îlet Gosier. Visit the local street market.

Day 8: Saturday (Bas du Fort Marina) Breakfast then navigation towards the marina. Disembarkation around 10:00 am at Bas du Fort Marina.

Note: This itinerary is subject to change depending on meteorological and technical conditions. The above-mentioned navigation times are based on an average speed of 6 knots. Navigation times may vary depending on sea and weather conditions. Dream Yacht Charters reserves the right to allocate another type of catamaran offering the same conditions of comfort and service.

• Standard Cabin mid-ship in a double cabin with private bathroom • Superior Cabin Upgrade when available to a slightly larger forward or back / aft cabin • Air conditioning in service from 8am to 10pm to reduce noise overnight. PLEASE READ THESE TERMS AND CONDITIONS (“ Terms ”) CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS AS WELL AS A SECTION GOVERNING THE JURISDICTION AND VENUE OF DISPUTES. THESE TERMS ALSO CONTAIN A LEGALLY BINDING RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK. By creating a username, a login, clicking submit, using the services of Charter Experts, LLC d/b/a Virgin Island Sailing® (“ Broker ) or by accessing Broker’s website, you agree that you have read, and acknowledge your acceptance of these Terms. The Terms are subject to change at any time without notice at Broker’s sole discretion. Additionally, any transaction for which you have made payment shall be governed by the form of Terms in effect at the time of such payment notwithstanding any subsequent changes hereto.

If you are obtaining a quote, information, booking travel for and/or securing or procuring a Charter (as that term is defined in Section 1 below) for more than just yourself, all references below to “Charterer” or “you” (and derivations thereof) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote, information, booking travel for and/or securing or procuring Charter.

These Terms shall be read together and construed, to the fullest extent possible, to be in concert with any other agreement by or among Broker and Charterer. To the extent they cannot be so construed, then in the event of any direct conflict between these Terms and any other agreement by or among Broker and Charterer (including but not limited to the agreement executed by Charterer for a Charter Reservation (as that term is defined in Section 1 below), these Terms shall prevail.

  • Prepaid Charter Reservations . Typically, Broker negotiates charter rates in advance with the yacht owner or charter company (“ Charter Provider ”) to obtain cost-effective rates, and facilitate reservations and availability for yacht charters, excursions and travel (the “ Charter ”). Broker also provides services to you by facilitating the booking of reservations for consideration and receives a commission from the Charter Provider (the “ Broker Fee ”). The Broker Fee is included in the pre-negotiated Charter rate provided to you, plus taxes and other fees where applicable. You agree that your payment is for the total amount set forth in the applicable Charter agreement (which Charter Provider may refer to as a Charter Contract, Charter Agreement, Booking Terms & Conditions, Instructions and Terms for Accommodations, as well as other derivations) provided to you by Broker (“ Charter Agreement ”). Upon execution of the Charter Agreement and receipt of the applicable deposit, you will have made a reservation for the Charter that authorizes Broker to facilitate the Charter on your behalf (“Charter Reservation”), including making payment arrangements with the Charter Provider. You further agree that Broker is a third-party beneficiary to the Charter Agreement and shall have the right to enforce such agreement to the extent it deems such enforcement necessary or advisable to protect its rights hereunder or under the Charter Agreement.

  Broker retains the Broker Fee as compensation in arranging your Charter Reservation. The Broker Fee varies based on the amount and type of Charter and/or services provided by Broker.  By making a Charter Reservation, you accept and agree to the relevant cancellation and no-show policy of the Charter Provider set forth in the Charter Agreement. Cancellation and no-show policies vary for each Charter. Carefully read the Charter Agreement and additional information provided to you by Broker. It is expressly agreed by Charterer that the Broker Fee is earned at the time the Charter Reservation is made. Late payment, wrong credit card or debit card details, invalid credit or debit cards, or insufficient funds are for your own risk and account, and you will not be entitled to any refund of any prepaid amount unless the Charter Provider expressly agrees otherwise under the Charter Agreement or in some other signed writing.

  • Charter Rules and Restrictions . Additional terms and agreements will apply to your Charter Reservation and any purchase or rental of equipment or other items, supplies, provisions and travel you may select. Please read those additional terms carefully. In particular, if you have purchased airfare, please ensure that you read the full terms and conditions of carriage issued by the supplier. You agree to abide by the terms of purchase imposed by any supplier with whom you elect to deal, including but not limited to payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability, charges, fares, and use of products and services.
  • Payment . All payments must be made by personal check, bank/wire transfer, ACH payment and/or with a major credit card unless otherwise expressly stated. The total price for the Charter Reservation will be billed in U.S. Dollars unless otherwise stated. Some banks and credit card companies impose fees for international transactions. If you are making a reservation from outside of the United States on a US credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the amount provided by Broker for the Charter Reservation. In addition, a foreign transaction fee may be assessed if the financial institution that issued your credit card is located outside of the United States. Booking international travel may be considered to be an international transaction by the financial institution or card company. The currency exchange rate and foreign transaction fee is determined solely by your financial institution on the day that it processes the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your financial institution. Broker shall not be liable to you for any such service, conversion, or exchange fee.

  Broker expressly reserves the right to cancel your Charter Reservation if full payment is not timely received as set forth in the Charter Agreement.

  • Cancellation and Rescheduling . You may cancel or change your Charter Reservation as set forth in the Charter Agreement by and among you, the Charter Provider and/or Broker. Please note that some Charter Providers do not permit changes to or cancellation of reservations after they are made, or after a certain date, as indicated in the Charter Agreement. You agree to abide by the terms of the Charter Agreement with respect to your Charter Reservation. Broker will not be responsible for reimbursing Charterer for any previously tendered deposits or payments by Charterer and disclaims all liability for the failure of a Charter Provider to refund or return any such funds.
  • Credit Card Transactions and Chargebacks . If for any reason, any Charter Provider is unable to provide the Charter, or any part thereof, for which you have contracted, your remedy lies against the Charter Provider, and not against Broker. However, Broker will use reasonable efforts to assist you and Charter Provider in reaching a resolution to a dispute between you and the Charter Provider. In the event that your payment has already been transferred from Broker to Charter Provider or to an escrow account, you agree that you will not seek a chargeback against Broker for such amounts transferred. You further agree to indemnify and hold Broker harmless from and against any liability, loss, damage or expense (including without limitation, reasonable attorneys’ fees) that Broker may incur in connection with chargebacks against Broker or under the Charter Agreement and your performance thereunder. If Broker incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company or other financial institution, you agree that you will be liable for these costs. If your payment is declined for any reason, you agree to settle any amounts owed to Broker via money order, cashier’s check, personal check or bank/ACH transfer immediately.
  • Broker Responsibility . Broker makes arrangements with the Charter Provider. Broker additionally makes additional arrangements with other suppliers for the various components and other services that comprise your Charter (“Charter Suppliers”). Broker is not an agent of these Charter Providers or the Charter Suppliers (and the Charter Providers and Charter Suppliers are not agents of Broker). Broker expressly disclaims any liability for the actions or omissions of the Charter Provider and the Charter Suppliers. The Charter Providers and the Charter Suppliers reserve the right to refuse service to you at their sole discretion. Broker assumes no liability for the acts of the Charter Provider or the Charter Suppliers in refusing service. Broker is not responsible for schedule changes and does not offer compensation for those changes. Broker is not responsible under any circumstances for any injury or damages you may suffer, in connection with sea, air or ground transportation, hotel accommodations, or other travel or excursion services arranged by Broker.

  You understand Broker is not the source or supplier of the Charter or other travel services you requested and acts solely as a broker for the Charter Provider and the Charter Suppliers. You agree that the Charter Provider and Charter Suppliers whose names appear in the information supplied to you are those who are solely responsible for providing the Charter you purchase. You consent to and request the use of the Charter Provider and the Charter Suppliers and agree to not hold Broker responsible should any of them: (i) fail to provide the Charter or travel services you purchased, whether or not such services are listed in the Charter Agreement or otherwise, (ii) fail to comply with any applicable law, or (iii) engage in any negligent act or omission that causes you any sort of injury, damage, delay or inconvenience.

By using Broker’s services, you waive and release any claim against Broker, its affiliated and subsidiary companies, and their respective officers, directors, employees, contractors, and agents, arising out of or in connection with any loss of or damage to property or injury to any person caused by reason of (i) any defect, negligence, or other wrongful act or omission, or any failure of performance of any kind, by any Charter Provider, Charter Suppliers, or any other provider of sea, airline, hotel, ground transportation or any other travel provider connected to or otherwise associated with the Charter, (ii) any claim for inconvenience, loss of enjoyment, mental distress or other similar claim, (iii) any delayed departure, missed connection, substitute accommodation, termination of service or change in fares or rates, and (iv) overbooking, flight or other travel cancellation, lost or misconnected personal property, or any claim arising out of the air transportation portion of your travel, and (v) or any other claim arising out of or otherwise related to the Charter Agreement or services provided by the Charter Provider and the Charter Suppliers.

Excepting only liability that directly arises from the gross negligence or willful misconduct of Broker, you will not hold Broker responsible for any injury, damage or loss you may suffer while on a Charter, whether incurred on the Charter or in connection with any other rental, purchase, excursion or activity, regardless of the relationship of any of the foregoing with the Charter Provider or the Charter Suppliers.

  • Your Responsibility . By booking a Charter with Broker, you agree to defend and indemnify and hold harmless Broker, Charter Provider, Charter Suppliers, and each of their respective officers, directors, employees and agents, from and against any and all claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal fees, arising out of or in connection with: (i) your breach of these Terms or the documents referenced herein; (ii) your violation of any law or rights of a third party; or (iii) your use of the Broker website.

You will review your Charter Agreement and travel documents for accuracy upon receipt. You understand that it is your responsibility to review the accuracy of all details in the Charter Reservation provided to you, and that you may contact Broker if you have any questions.

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).

You understand that Broker recommends purchasing travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

  • No Warranties . All Charters, products, services, advice and information is provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied to the fullest extent permitted under the law, including but not limited to, warranties of title or implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made (i) regarding the acceptance of any reservation request or Charter Reservation; (ii) regarding the availability of Charters, or any other product and/or services through Broker; (iii) that the use of Broker’s website will be error-free; or (iv) regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided by Broker or through Broker’s website.

Broker has no special knowledge regarding the Charter Provider’s or Charter Supplier’s financial condition, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel during or otherwise in connection with your Charter.

  • Limitation on Liability . In no event shall Broker, Charter Provider, Charter Suppliers, and/or their respective affiliates, or any employees, agents, officers, directors, members or managers of any of the foregoing (“Broker and Charter Releasees”), be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use the Broker’s website, the Charter or services provided to you in connection with the Charter (including, but not limited to, your reliance upon opinions of the Broker), whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Broker and/or any other of the Broker and Charter Releasees have been advised of the possibility of such damages.

If, despite the limitation above, Broker or the Broker and Charter Releasees are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then Broker, Charter Provider, Charter Supplier and the Broker and Charter Releasees will in no event exceed, in the aggregate, the greater of (a) the Broker Fee, and (b) One-Hundred Dollars (US $100.00).

The foregoing limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose. The limitations of liability provided in these Terms inure to the benefit of Broker and/or its providers.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

  • Limitation on Time to File Claims . ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF RELATING TO BROKER’S SERVICES OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
  • Waiver . No waiver by Broker of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Broker to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
  • Severability . If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
  • Governing Law and Mandatory Venue . The laws of the State of Florida govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. You agree that any action or proceeding initiated by Charterer against Broker shall be brought solely in the federal and state courts of Hillsborough County, Florida, and you submit to the jurisdiction of those courts and waive any objections to the exercise of personal jurisdiction over you by those courts. In the event any action or proceeding is initiated by Charterer in a court outside of Hillsborough County, Florida, Charterer agrees to pay Broker’s costs and reasonable attorneys’ fees associated with defending such action or proceeding and waives any and all defenses to the transfer of said action or proceeding, whether jurisdictional or otherwise, to a federal or state court in Hillsborough County, Florida.
