TERMS AND CONDITIONS OF CHARTER

1/       Definitions

In this agreement, the following terms have the following corresponding meaning: “Charter” shall mean the vessel for which the Charterer is paying. “Charterer” shall mean the person signing this agreement and any company, club, group or association embarked on the vessel on behalf of whom this agreement has been signed including the guest of any such member of any company, club, group or association. “Company” shall mean Tork Communications Pty Ltd, trading as Prestige Harbour Cruises through which the Charter was booked. ”Vessel” shall mean any vessel supplied for the purpose of the charter by the Operator. “Operator” means the owner or operator of the Vessel as specified.

2/     Online Bookings

When you make a booking, Prestige Harbour Cruises reserves the right to accept or reject the booking for any reason, including, without limitation, the unavailability of any product or service, an error in the price or the product or service description posted on our web site or an error in your booking.

3/       Tentative bookings will be held for a maximum of 48 to 7 days (depending on the Operator), unless there is another request for the same time slot and date then the booking must be confirmed with a deposit.

4/      Deposit: A deposit of 50% will be required to confirm your booking unless otherwise agreed. On receipt of the deposit your booking is confirmed and subject to terms and conditions of this charter contract.

5/       Security Bond: The Charterer is required to pay a security bond or provide a pre-authorised credit card guarantee to the value of the bond amount. The security bond may be applied by the Operator to cover additional costs including but not limited to damage to the vessel, its equipment and fittings, additional services, excessive cleaning charges and any other costs attributable to the Charterer’s Group. The security bond or the balance thereof will be refunded 7 days after the Charter.

6/       Cancellations: All cancellation requests must be in writing a)     31 days or more prior: Deposit is non-refundable b)     30 – 14 days prior : Total monies paid are not refundable. c)     Less than 14 days prior : Full payment is non refundable

7/       COVID Policy

All Operators adhere to the NSW Public Health COVID-safe regulations for hospitality venues. If the govt enforces stricter conditions and the cruise cannot proceed, you will be able to choose to reschedule for a date within 6-12 months of your original cruise date. The details of your rescheduled cruise should be like for like, and the reschedule period may exclude certain periods of dates. Please note that if pricing for the new date selected has different rates, you will be required to pay the difference, or vis versa, the difference will be credited back to you. This would be based on the restrictions that are in place 14 days prior to your cruise date.

A change to the date would only be allowed if govt rules meant the cruise couldn’t run. A reschedule or cancellation for any other reason will be subject to our standard reschedule/cancellation policy and fees will be incurred.  If you have ordered catering for your cruise, and the cruise is cancelled or rescheduled within 7 days of the cruise date, you may be required to pay for this catering, irrespective of the reason for the reschedule or cancellation.

8)      Final Charter Details: required 14 days prior to the charter date:

a)    Final guest numbers , any dietary requests and male/ female guest ratio. The balance invoice will be calculated the on final guest numbers specified by the Charterer and will be deemed the minimum number of guests for catering charges. Guest numbers may increase within 14 days of the charter date if agreed, however they cannot decrease.

b)    Passenger Manifest: List of passenger names, contact numbers (where possible) and residential suburb/ state will be required

c)    Final Payment: Final payment is required 14 days prior to the Charter unless otherwise agreed. Catering charges for additional passengers thereafter will be invoiced and charged according.

9/      Additional Charges: Any additional charges on the day of service are to be immediately charged to the credit card or taken from the security bond provided by the Charterer. This includes but is not limited to extensions of Charter, additional guests, additional services, pay-­ ‐ on-­‐consumption beverages, waiting time for embarking and disembarking at wharves, and any other additional charges notified by the vessel operator

10/      Responsible Service of Alcohol, Smoking and Behaviour a)    In accordance with Liquor Licensing Act, the Company practices responsible service of alcohol. Any persons deemed to be intoxicated will be refused service of alcoholic beverages. b)    Under clubs and restaurants act smoking is only permitted in the dedicated smoking area of the vessel. c)    Indecent behaviour on a licensed vessel is prohibited under the Liquor Act and your charter will be terminated in the event of unacceptable behaviour as determined by the crew, and if such circumstances occur there will be no refunds. Nudity, prostitution and illicit drugs are prohibited on all charters

11/     Substitute Vessel

In the event the Operator is unable supply to the booked vessel, the Company reserves the right to provide another vessel in order for the Charter to be completed.

12/     Weather Conditions

All Charters will proceed regardless of weather conditions unless deemed unsafe by the by the Master on the day.

13/     Charter Course

The course to be undertaken during the Charter may be agreed in advance. The Charterer acknowledges that the Master has the sole discretion at all times to take whatever action is necessary to protect and maintain the safety, welfare and good order of the vessel, its passengers and crew with regard to the weather conditions and other activity on the Harbour.

14/      Embarkation and Disembarkation

The Vessel will dock at the times stated on the booking confirmation. All guests have 10-15 minutes to board and disembark from the times stated in the booking confirmation. Excessive boarding and disembarkation will be charged at a pro-­rata hourly rate.

15/      Responsibility of the Charterer

The Charterer is at all times responsible for the conduct of the Charterer’s group

16/      Damage to the Vessel

The Charterer shall indemnify the Company in respect of any loss or damage to the Vessel or its equipment or fittings howsoever caused by the Charterer’s Group. Fair wear and tear excepted

17/      Limit of Liability

It is a condition of the Charter that the liability of the Operator, its servants, agents, employees and subcontractors is agreed to be limited in accordance with the Limitation of Liabilities and Maritime Claims Act 1989 (Cth ) and that any claim for loss or damage must be notified in writing within 7 days from the day of the Charter and any court action, suit or proceeding must be brought within 1 year of that date.

18/      Indemnity

The Charterer agrees to indemnify and hold harmless the Operator, the Agent, their agents and employees, from and against any and all losses, claims, actions, costs, expenses, fees, damages, fines and liabilities (including reasonable legal fees) caused by any negligent act or omission by the Charterer or members of the Charterer’s Group including:

(i) Failure to follow any reasonable direction given by the master or crew; (ii) Failure to comply with any of these terms or conditions; (iii) Failure to comply with any warning sign; (iv) Unreasonable or unsafe behaviour; (v) Wilful misuse of the equipment or facilities of the vessel; (vi) Intoxication or the use of prohibited drugs.

19/      Risk Warning

There are inherent risks and dangers on board any vessel. All passengers participate in the Charter entirely at their own risk.

20/      Swimming

Swimming is only permitted during daylight hours when the vessel is stationary and in the absolute discretion of the crew.

21/      Jurisdiction

The laws of New South Wales govern this agreement and the parties agree to submit to the jurisdiction of the Courts of New South Wales in respect of any disputes arising between them.

22/      Acceptance

By accepting the quotation and paying a deposit, the Charterer agrees to be bound by these Terms and Conditions.

Where do the boats travel to.

Some boats can travel through the Yarra River waterways, offering a vibrant sightseeing experience under the bridges, past the Crown Casino and across the entire city skyline. The larger party boats are too high to travel under the bridges so they are limited to the area around the MCG Stadium and Port Phillips Bay which is a much larger pool of water.

Where do the boats depart from?

Most of our boats depart from Victoria Harbour Promenade in Docklands . Wharf directions are provided in your booking confirmation depending on the boat you book.

Our larger party boats are decked out with a dance floor, sound and lighting systems.

Our smaller boats are more casual loungy boats (these ones can travel far up the Yarra River under the low bridges for a full sightseeing experience).

What happens in bad weather?

Fortunately all our boats are sheltered so they are not affected by the rain. But we suggest you check the weather forecast so you’re prepared for travelling to and from the vessel.

How does the booking process work?

Ready to book? We’ll send you a booking confirmation and once you’ve paid a deposit the boat is locked in for you! The balance isn’t due until the week before the event, which gives you time to confirm the number of guests attending and make any changes to your package. We’ll also send you an itinerary the week of your cruise with an updated summary of your cruise, pick-up location and contact details of your skipper. The Home Office will re-open two immigration centres, as well as recruiting up to 100 new intelligence officers to target people smuggling gangs. ITV political correspondent Shehab Khan reports

The home secretary has announced new measures to curb illegal immigration, boost border security and increase deportations.

Yvette Cooper is aiming for the highest removal rates since Theresa May's tenure as home secretary, insisting the home office is taking "strong and clear steps to... ensure the rules are respected and enforced".

The measures include hiring up to 100 specialist intelligence and investigations officers at the National Crime Agency (NCA) to dismantle criminal smuggling gangs and prevent dangerous boat crossings.

This follows a 50% increase in the number of NCA officers stationed at Europol, which is currently conducting around 70 active investigations into people smuggling and trafficking groups.

Cooper said the officers have been swiftly deployed to support European operations targeting criminal smuggling gangs profiting from small boat crossings.

She assured that a range of sanctions, including financial penalties, business closure orders, and potential prosecution, will be imposed on employers of illegal workers.

There will also be a significant increase in enforcement and deportation flights, aiming to reach the highest removal levels since 2018, reversing the recent decline.

Detention capacity will be expanded with 290 additional beds at Campsfield Immigration Removal Centre, in Oxfordshire, and Haslar, in Hampshire.

This increase aims to provide the additional space needed to support higher levels of enforcement and returns, ensuring that immigration rules are properly enforced.

Staff will be redeployed to support the increased returns, which have dropped by 40% since 2010.

Some 300 caseworkers have already been reassigned to handle thousands of failed asylum and return cases, including both enforced and voluntary returns, the government said.

Additionally, sanctions will be imposed on "unscrupulous" employers who hire illegal workers.

Cooper said Border Security Command “is gearing up” to increase removals after the number of migrants crossing the English Channel in small boats topped 19,000 this year so far.

The home secretary said: "Our new Border Security Command is already gearing up, with new staff being urgently recruited and additional staff already stationed across Europe.

"They will work with European enforcement agencies to find every route into smashing the criminal smuggling gangs organising dangerous boat crossings which undermine our border security and put lives at risk.

"And by increasing enforcement capabilities and returns, we will establish a system that is better controlled and managed, in place of the chaos that has blighted the system for far too long.”

Shadow Home Secretary James Cleverly called the government's response "pathetic" as he said their plans are not ambitious enough to tackle the scale of the issue, and called it out for scrapping his administration's Rwanda policy.

He said: "I returned 30,000 people a year on average when I was home secretary, the fact is their aspirations are too low, their energy is too low, the National crime agency - which said it needed a deterrent - and yet the first thing the government did upon entering office is to scrap that very deterrent.

"They still haven't recruited a commander for this phantom border command. Their rhetoric is falling apart and their action is falling well below what the country needs."

Home Office figures showed 206 migrants crossed the English Channel in three boats on Monday, which has taken the 2024 provisional total crossings to 19,294. This is a 10% increase on the figure recorded last year, which was 17,620. But the latest figure is 10% down on 2022, when 21,344 crossings were recorded in the same period.

According to figures released by Labour ministers in July, the previous Tory government spent around £700 million on its flagship Rwanda scheme before the General Election earlier this year.

The programme, designed to deter illegal arrivals by small boats to England through a treaty with Kigali, aimed to relocate some individuals to East Africa.

However, only four volunteers arrived in Rwanda, and Sir Keir Starmer declared the scheme "dead and buried" within two days of becoming prime minister.

NCA director general of operations, Rob Jones, said: “Tackling organised immigration crime remains a key priority for the NCA and we are dedicating more effort and resource than ever before.

“These extra officers will play a key role in that, with the NCA currently leading around 70 investigations into the highest harm people smuggling and trafficking groups."

Care4Calais CEO Steve Smith said: “The new Government continuing to invest in border security rather than workable solutions is repeating the mistakes of the last government.

“The evidence shows that these so-called deterrents don’t work. They do nothing to reduce Channel crossings, they just force people to take greater risks to do so.

“The only way to stop crossings, and to save lives, is to create safe routes for people to claim asylum in the UK. That’s what the new Government should be focusing on.”

Rescue teams are battling rising water levels in the search for two pilots and up to seven tourists who are trapped in a plane that crashed in a mangrove forest.. Police believe the crew and holidaymakers are entombed inside the cabin 16ft under swamp-like mud in the wooded area in Chachoengsao, 150km east of Bangkok. They fear the nearby tidal river will submerge the area by 10pm and are using an excavator to try and reach those inside. Flight records show the Cessna 208B Grand-Caravan took off from the Suvarnabhumi International Airport transferring the tourists to the Ko Mai Si Airport, a small air strip on a remote island. The were then due to be taken by boat to the luxury SOtraveler hotel on the larger Koh Khood island. But the aircraft crashed and burst into flames in a swamp in Chachoengsao province shortly before 3:30pm local time. Locals said they heard an explosion. Authorities are currently searching for the missing pilot and passengers. Pictures from the scene show a picture from a female clothing along with a Prada wallet and other travel accessories, including a pre-paid tourist sim car. Local media reported that two pilots were onboard and seven passengers were listed. Their identities and nationalities have not been disclosed. Police Lieutenant Warayut Chanwichumet, Deputy Chief of Investigation from the Bangpakong district said rising water levels from the river were hampering search efforts. The policeman said: ‘The nose of the plane was stuck in the mud more than five meters deep. Rescuers from Chachoengsao are mobilising to search, but the current problem and obstacle is that the water is rising. ‘The water pumps are unable to contain it. However, they are urgently searching for the missing persons.' Nattharat Nunpradech, Public Relations Officer of Chachoengsao Rescue Unit, said that while searching, they found pieces of the plane scattered throughout the mangrove forest. He said: 'Officers tried to search for the remains of the small plane but found only bags and luggage. Most of the debris found was debris from the rear of the plane. 'As for the cabin for passengers, it is likely buried in the mud and all the passengers are likely in there. The current obstacle is that the two backhoes have not been able to dig up the soil yet because the surrounding area is all mud. The water level in the sea is now rising in the area. Officials prepared a water pump, but the water kept coming down and filling the area, so they still couldn't dig up the wreckage.' Resident Ang Trasawat, 69, said he heard a loud explosion before running to the crash site, where they found scattered pieces of the plane. He said: 'There were explosions in the air. Before the plane fell, the sound was loud, then the plane fell to the ground. After that, I ran to see the scene. Pieces of the plane had been scattered around, including near a house.' Preecha Boontham, 56, added: 'I heard the plane accelerating very loudly. There was no smoke coming out. Then the plane descended towards the fields and landed in the mangrove forest. It was a small white plane with two wings. After the crash, there was a loud explosion.' The aircraft HS-SKR was last registered to Siam General Aviation before being used by Thai Flying Service Co Ltd. It was reportedly being used for a private charter flight when the crash happened. Records show it departed from Suvarnabhumi International Airport in Bangkok at 2.46pm on August 22, bound for Koh Mai Si Airport in Trat, with flight TFT209, before losing signal at 2.57pm. Police said they have closed the area while they search for survivors of the crash. Police Lieutenant Warayut Chanwichumet, Deputy Chief of Investigation from the Bangpakong district station said they received a report of the crash and sent police and paramedics to the scene. At the site, they found the wreckage of the plane scattered in the mud across an area of approximately 328 feet (100 metres). They were unable to locate any pilot or passengers but discovered baggage from those onboard. The police officer added: ‘We have blocked off the area to prevent further accidents due to an oil leak from the plane. ‘We have inspected the wreckage and have not yet found any pilot or passengers. We will expand the search radius and dig the ground beneath the wreckage to locate the pilot and passengers. ‘We will also inspect the flight information to determine the plane's owner and the number of passengers.'
