Broker’s Comments

The Volvo Ocean 65 was developed by Farr Yacht Design in response to the escalating costs and fragility of the Volvo 70 campaigns in the 2012 Volvo Ocean Race.

There was a real need for a more robust yacht that still possessed the sailing characteristics of the Volvo 70 but in a much more durable form, all while keeping costs down. A study on the performances of both yachts showed that the Volvo 65 is only roughly 2-3% slower than a Volvo 70 on the ocean route and significantly more robust.

Recently, after The Ocean Race, the yachts have demonstrated their potential in offshore racing, with two Volvo 65s ranking in the top 5 overall in the 2023 Fastnet race. These were standard yachts in one-design trim. There is a lot of potential for optimization for handicap racing, following the success of the Volvo 70s.

AMBERSAIL, formerly TEAM SCA, underwent a major refit as part of the Volvo 65 fleet refurbishment but did not participate in the race. Since then, she has been involved in Caribbean and coastal racing.

She is the only Volvo 65 that has completed a circumnavigation.

She remains in good condition, well-maintained, and has the advantage of a spare mast in the inventory.

The Volvo Ocean 65 is the new one-design boat that contested the 2014-15 edition of the Volvo Ocean Race. It will also be the one design used for the 2017-18 edition. At 65ft LOA the new yachts are slightly shorter than the previous generation of Volvo Open 70s but will be more reliable, robust and affordable while still being a very high performance racing boat.

The new boat is designed by Farr Yacht Design with a consortium of four boatyards taking care of the build process — Green Marine in the United Kingdom, Decision in Switzerland, Persico in Italy and Multiplast in France.

“Farr Yacht Design is pretty uniquely positioned in that we have an enormous Volvo Ocean Race experience," said Patrick Shaughnessy, President of Farr Yacht Design. "We have designed 40 boats for the race, been involved in nine editions, the last few campaigns we've been on the ground 100 percent of the time supporting the teams and really been part of the race, and the thing that makes us a little unique is that we can combine that with an enormous one-design experience. I don't believe there's another team in the world that can present all those parts and that's really I think what makes us ideally suited for this opportunity.”

Volvo 65 Sisi is the boat of The Austrian Ocean Race Project, a young and ambitious team of international sailors – with an Austrian core – united by their passion for big boat sailing. Their big goal is to participate in the Ocean Race 2023, for which they have purchased the former Vestas 11th Hour Racing, a VO65, which has already competed in the Volvo Ocean Race twice. For all those who want to take part in this adventure, there is the possibility to join for races, deliveries and open trial days.

Apart from a few exceptions, Sisi is only available for races to entire crews (Whole Boat Charter). Deliveries are open to everyone.

The Volvo Ocean 65 is a One Design class, there are only 8 boats of this class in the world. Designed and built for the 2014-2015 edition of Volvo Ocean Race, they sailed across the world twice- in the 2014-2015 edition and the 2017-2018 edition.

This boat was created for facing the toughest conditions of the Southern Ocean, has highly advanced technologically onboard and has spartan conditions inside.

The entire set of sails on Volvo 65 Sisi are produced by North Sails using their patented 3Di technology. the sails are made of RAW760 Ultra PE/Aramid. According to the class rules, carbon can not be used in the sails. carbon can restrict the satellite connection. A novelty to the Volvo 70’s are the outriggers. They make it possible to move the sheeting point of the headsail outwards. The Volvo 65 often sails triple-headed, i.e. with three headsails, which creates a deep sail pressure point with maximum sail area.

We collected some frequently asked questions about sailing on Volvo 65 Sisi for you.

Basic sailing experience is required.

Arrival /Departure

The dates given are the departure or estimated arrival date. The meeting point is on the day of departure in the morning, the exact time will be announced 3 weeks in advance. As our arrival at the destination port depends on wind and weather conditions, we advise you to allow for a time cushion of a few days when booking your return flight or to take out cancellation insurance for the flight. sailing experience is required.

The route planning or time schedule can be kept very realistically, but there can be delays due to wind and weather conditions. Therefore, we cannot guarantee the schedule.

The meeting point is directly at the ship. You will be informed about the exact location 3 weeks in advance.

Usually, the ship is already in the harbour the day before and after prior arrangement with us, you are welcome to sleep on board.

Safety on Board

You are welcome to bring your own life jacket with a life belt. Please note, however, that we require life jackets with Hammar trigger (NO UML trigger!) and integrated AIS. If you do not have such a lifejacket, you can borrow one from us for a rental fee of €40. Please also note that life jackets often cause delays with luggage when flying, so please check with your airline in advance.

Yes, life belts are included with our life jackets.

There are numerous remedies against seasickness (just ask at the pharmacy). If you are prone to seasickness, please make sure to make the necessary provisions in advance. Of course, we also have medication on board. If you have any questions regarding seasickness, you can also contact the boats medical team.

If weather conditions endanger the safety of the crew and the ship, the ship will not leave port, or (if possible) enter a safe harbour. Unfortunately, we cannot assume liability for missed flights due to delays.

Please bring at least one set of oilskin.

Please only waterproof shoes with light-coloured, non-slip soles and sailing boots.

Hygiene on board

There is no shower on board. You can either take a shower using water bottles or use wet wipes.

Yes, but the use of the toilet is relatively demanding in heavy seas. Your privacy is guaranteed by a curtain.

Food & Drinks on board

Basic food is provided by us.

Generally, we eat freeze dried food (infused with hot water). On shorter deliveries and for the first days of longer deliveries, we also have fresh fruit. For in between we also have muesli bars. Please let us know in advance if you have any intolerances or if you are vegetarian.

Drinking water is made on board by a watermaker. You are welcome to take along effervescent tablets with vitamins or minerals as well as isotonic drink powders.

Yes, please bring a drinking bottle labelled with your name.

Sleeping on board

The crew is divided into 2 watches. Basically the watches work like this:

1st watch from 6-12

2nd watch from 12-18

1st watch from 18-22

2nd watch from 22-02

1st watch from 02-06 and so on (short-long night).

The watch system can also be changed in bad weather conditions. But this is no guarantee that you can always sleep through the night, because during manoeuvres it can happen that “all hands on deck” are needed.

As it is very loud in the ship, earplugs are recommended.

As you prefer.

They are standard tube bunks, which are really comfortable by the way.

A cushion is highly recommended.

Working on board

All cooperation is obligatory. Each crew member is assigned a task based on their sailing skills.

If you already have sailing experience, you can steer the boat. Please note that the skipper is carrying all responsibility and decides who can steer the boat.

Advanced Charter Allowance

ACA consists of the following components:

• Any mooring fees
• Proportional excess insurance

We charge a flat rate of 55 € per day.

The following costs are not included in ACA:

• Entry fee for regattas

• Accommodation at the place of departure and place of arrival

Miscellaneous

Yes, there is a 12-volt socket onboard.

Please only use foldable bags. Please also bring a smaller bag for the most important and quickly accessible items of clothing. Waterproof bags are generally recommended.

Gerwin Jansen, Head of Sailing Team

Gerwin was born in 1981 in Hasselt in the Netherlands. At the age of five years, he began sailing in the Optimist. He became Dutch champion in different boat classes multiple times before he earned two world champion titles in the ORC class. Gerwin has 15,000 nautical miles of offshore experience and alongside his sailing activities, he runs One Sails Netherlands.

Like for every sailor, the Ocean Race is a huge dream for me.

And further, the team exists of 10 enthusiastic experienced (young) sailors, several specialists responsible for sustainability, meteorology, legal affairs, and a medical, marketing, boat and management team. So you will be part of a well-organised sailing project.

For Sailing Yacht Volvo 65 Sisi

1.1. The following general terms and conditions in the version valid at the time the contract is concluded apply to the business relationship between Ocean Racing GmbH – hereinafter referred to as Ocean Racing – and the customer.

1.2. Customers are legal persons and natural persons with unlimited legal capacity who have reached the age of 18.

1.3. These terms and conditions apply exclusively. Ocean Racing does not recognize any conflicting or differing terms and conditions of the customer and hereby objects to them.Exception: Ocean Racing has expressly agreed to their validity in writing

1.4. If individual provisions of these General Terms and Conditions are or should become wholly or partially ineffective due to mandatory statutory provisions (due to mandatory provisions of the Consumer Protection Act) or if there is a loophole, the contracting parties will make one of the ineffective or incomplete provisions that come as close and legally effective as possible from the economic result . The validity of the remaining provisions remains unaffected.

1.5. These general terms and conditions also apply to all further legal transactions concluded with the customer after the first legal transaction.

• CONCLUSION OF CONTRACT

2.1. All offers from Ocean Racing are non-binding and subject to change. The offers from Ocean Racing are understood as an invitation to the customer to submit a binding offer. The information contained in brochures or similar documents and the information provided with an offer as well as illustrations, drawings, descriptions, dimensions, weight and performance data are only approximate unless they are expressly designated as binding. Minor deviations from the description of the offer are considered approved and do not affect the fulfillment of the contract unless the deviation is unreasonable for the customer.

2.2. A contract between the customer and Ocean Racing is only concluded through written order confirmations (mail or email) from Ocean Racing.

• RIGHT OF WITHDRAWAL (KSchG)

3.1 The customer, who is a consumer within the meaning of the Consumer Protection Act (KSchG), acknowledges that, in accordance with §3KSchG, he can withdraw from his contract or from the contract if he does not use the contractual declaration in any of Ocean Racing’s for business purposes Has given up at a booth used by Ocean Racing at a trade fair or market.

3.2. This withdrawal can be declared until the contract is concluded or afterwards within 14 days.

3.3. The right of withdrawal also exists if Ocean Racing or a third party cooperating with Ocean Racing brings the customer to the rooms permanently used for business purposes by Ocean Racing as part of an advertising trip, an excursion trip or a similar event or by personal, individual address on the street Has.

3.4. The exercise of the right of withdrawal does not require any special form. However, for reasons of evidence, adherence to the written form is recommended. The cancellation deadline is met if the cancellation notice is sent within the deadline.

3.5 The customer is not entitled to withdraw from the contract,

– if he himself has initiated the business relationship with Ocean Racing or its agents to conclude this contract,

– if the conclusion of the contract has not been preceded by any discussions between the parties or their agents, or

– for contracts that are subject to the Distance and Foreign Trade Act (FAGG), or

– in the case of contractual declarations made by the consumer in the physical absence of the entrepreneur, unless he was urged to do so by the entrepreneur.

• WITHDRAWAL RIGHT (FAGG)

4.1 The customer, who is a consumer within the meaning of the KSchG, can withdraw in writing from a distance contract or from a distance contract until the deadlines specified below. It is sufficient if the cancellation notice is sent within the period. The withdrawal period is 14 working days, with Saturday not counting as a working day. In the case of contracts for the delivery of goods, it begins on the day they are received by the customer, in the case of contracts for the provision of services on the day the contract is concluded.

4.2. According to Section 18 Paragraph 1 No. 3 FAGG, the customer has no right of withdrawal in distance selling transactions or outside of business premises, contracts concluded for goods that are made according to customer specifications and are clearly tailored to personal needs.

4.3 To exercise the right of withdrawal, the customer must inform Ocean Racing of his decision to withdraw from the contract by means of a clear statement (e.g. a letter sent by post, fax or email). The customer can use the attached model withdrawal form.LINK

4.4 If the customer withdraws from this contract, Ocean Racing has to reimburse the customer all payments that Ocean Racing has received from the customer immediately and at the latest within 14 days from the day on which the notification of withdrawal from the contract was received by Ocean Racing. For this repayment, Ocean Racing uses the same means of payment that the customer used in the original transaction, unless expressly agreed otherwise with the customer; under no circumstances will the customer be charged for this repayment.

• PRICE / PAYMENT TERMS

5.1. Unless otherwise expressly stated, all prices stated by Ocean Racing are net prices plus VAT.

5.2 In the event of subsequent changes to the scope of services or the resulting costs, Ocean Racing is entitled to offset the corresponding additional costs.

5.3. When the booking is made, the customer must bring the agreed total price to the account of Ocean Racing within 7 days of the corresponding invoice.

• CANCELLATION COSTS

6.1 If the customer withdraws from the contract outside of the possible cancellation options under KSchG and/or FAGG, Ocean Racing is entitled to withhold the following staggered cancellation costs:

-Withdrawal up to 12 weeks before the start of the service, 50% of the total amount

-withdrawal within the last 12 weeks before the service is provided, 90% of the total amount

• RIGHT OF WITHDRAWAL BY OCEAN RACING GMBH

7.1. If a minimum number of participants is provided for a cruise offered by Ocean Racing, Ocean Racing is entitled to withdraw from the contract up to 8 weeks before the service is performed if the minimum number of participants is not reached. In such a case, Ocean Racing will immediately suggest an equivalent replacement trip to the customer, which the customer can accept without additional financial services.

If the customer rejects the alternative service offered for whatever reason, Ocean Racing will reimburse the customer for the money he has paid up to that point. The customer has no further claims.

7.2. Ocean Racing reserves the right to terminate the contract with the customer or the execution of the service immediately if the customer persistently disrupts the performance of the service (sport-oriented cruise) despite warning. In such a case, the customer will not be reimbursed. The customer has to bear any additional costs for return transport, despite the warning, persistently disturbing or endangering.

• SCOPE OF SERVICES

8.1 The performance owed results from the contract concluded with the customer, the travel description and the manual.

8.2 The offered sea trips take place on rented or company-owned sports boats.

8.3. Ocean Racing sees itself as a charter company and only offers berth charter services. Unless otherwise agreed in writing, the scope of services includes the stay and overnight stay in a bunk, the provision of a trained skipper as well as sporting activities in the form of sport-oriented maritime navigation and accruing yacht insurance as well as fuel, port fees or food costs on board. The customer is responsible for his arrival and departure to or from the departure or final port, as well as for his meals in the event of any shore excursions.

8.4 Ocean Racing expressly reserves the right to make any necessary changes to the advertised yacht while maintaining the same standard (e.g. in the event of technical problems with the yacht actually intended).

8.5 If destinations are advertised in the travel description, these are only listed as examples, unless they have been expressly agreed as binding. Decisive is the advertised local area in which the sailing yacht, which is supposed to reside.

8.6 The customer acknowledges that the practice of sailing takes place outdoors and on the high seas. The services to be provided by Ocean Racing are therefore also considered to have been carried out if a planned route has to be changed due to persistent bad weather, the general safety situation in the planned area or due to technical reasons; The same applies if, for such reasons, the yacht cannot leave and must remain in the port, or if the customer cannot make the trip due to illness or has to leave prematurely. This disclaimer does not apply to cases of gross negligence or intent attributable to Ocean Racing.

9.1 If the customer is a consumer, liability in the event of a slightly negligent breach of duty is limited to the direct average damage that is foreseeable and typical for the type of service. This also applies to slightly negligent breach of duty by employees, workers, representatives or vicarious agents.

9.2 If the customer is an entrepreneur, a legal entity under public law or a special fund under public law, claims for damages are excluded regardless of the type of breach of duty, including unlawful acts, unless there is willful or grossly negligent action. If essential contractual obligations are violated, Ocean Racing is liable for any negligence, but only up to the amount of the foreseeable damage. Claims for lost profit, saved expenses, third party claims for damages as well as for other indirect and consequential damages cannot be claimed.

9.3 We do not assume any liability for damage caused by improper use or natural wear and tear. The user undertakes to handle the yachts and furnishings with care. Damage to property – also caused by negligence – will be repaired at the expense of the person who caused it.

9.4 To the extent that liability is excluded or limited, this also applies to employees, workers, representatives and vicarious agents.

9.5 The liability limitations and exclusions do not apply to claims that have arisen due to fraudulent behavior, as well as liability for guaranteed quality features, for claims under the Product Liability Act and for damage to life, limb or health.

9.6. Ocean Racing’s liability to contractors is limited to the maximum amount of existing liability insurance.

9.7. Compensation obligations of entrepreneurial customers are to be asserted within 6 months in the event of other forfeiture. For consumers, the legal provisions apply.

9.8. This disclaimer also extends to claims against employees and/or vicarious agents of Ocean Racing.

• CUSTOMER’S DECLARATION

10.1. The customer is not only a mere passenger but also part of the crew as part of the sport-oriented maritime shipping and must follow the instructions of the ship’s captain.

10.2. The customer confirms that he is in good physical shape in order to be able to complete the demanding participation in the sport-oriented shipping. The customer is obliged to have his physical suitability checked by a doctor if necessary.

10.3. Unless Ocean Racing has any other information from the customer, Ocean Racing can and must assume that the customer is physically healthy and able to swim.

11.1. By concluding the contract, the customer consents to the collection, processing and use of his personal data by Ocean Racing, provided that this data is necessary for the provision of the agreed services.

11.2. Ocean Racing does not sell, exchange or use the customer’s personal data and information in any other unauthorized manner. Ocean Racing does not pass on personal data from customers to third parties, unless the customer has given their consent or there is a legal obligation for Ocean Racing to disclose the data.

11.3. The customer has the right to request information at any time about the data stored about himself at Ocean Racing and any recipients of this data. This information is free of charge and is generally given in writing by e-mail, in exceptional cases (if the customer cannot receive it). The request for information is to be sent to Ocean Racing in writing and signed by hand, with a copy of the identity card or proof of authorization to represent a legal person.

11.4. Within the framework of the legal requirements, the customer has the right to request the correction or deletion of the data stored by him at any time. An email with the following information is sufficient:

Name / company, date of birth / commercial register number and email address of the customer as well as customer or booking number of the last booking.

The customer is aware that data protection for data transfers on the Internet is not yet fully guaranteed according to the current state of the art. In particular, e-mails do not represent secure communication, since the reading out of content cannot be technically excluded. In this respect, the customer is responsible for the security of the data he transmits to Ocean Racing.

• JURISDICTION / APPLICABLE LAW

12.1. Only Austrian law is applicable to any contractual relationship with the customer, excluding the conflict of laws rules.

12.2. For disputes arising from and in connection with this contract, the jurisdiction of the court responsible for 1190 Vienna is agreed – insofar as legally permissible.

• OTHER AGREEMENTS

13.1. The skipper is responsible for the ship and the customers. The customer is expected to follow the skipper’s instructions.

Mike Lynch, one of the UK’s best-known tech entrepreneurs, is among those missing after a luxury yacht sank off the coast of Sicily in bad weather.

Lynch, the former chief executive of Autonomy, was acquitted of criminal charges by a jury in San Francisco in June, vindicating the 59-year-old entrepreneur after a 12-year legal battle over the software group’s $11bn sale to Hewlett-Packard in 2011.

Among the passengers on Lynch’s 56-metre yacht Bayesian were members of his legal team and their families, who had been invited on the trip to celebrate the courtroom victory.

Jonathan Bloomer, chair of insurance group Hiscox and Morgan Stanley International, who appeared at the trial as a witness for the defence, was also on board and is one of those missing, according to local Italian authorities and people familiar with the matter.

Hiscox chief executive Aki Hussain said the company was “deeply shocked and saddened” by events. “Our thoughts are with all those affected, in particular our chair, Jonathan Bloomer, and his wife Judy, who are among the missing, and with their family as they await further news from this terrible situation.”

Christopher Morvillo of law firm Clifford Chance, who represented Lynch, is also missing. Six guests in total are missing and one member of the crew is confirmed dead.

Another Clifford Chance lawyer, Ayla Ronald, was among 15 of the 22 guests and crew who the authorities said were rescued from the stricken vessel.

Lynch ’s 18-year-old daughter Hannah is also missing while his wife Angela Bacares was rescued.

The yacht incident came on the same day as the death was confirmed of Lynch’s co-defendant in the US fraud case, Stephen Chamberlain, who was hit by a car in Cambridgeshire.

Gary Lincenberg, an attorney who represented Chamberlain in the case, said Autonomy’s former vice-president of finance, whom he described as a “courageous man with unparalleled integrity”, had been fatally struck by a car while out running on Saturday.

Following the courtroom verdict, Lynch had said he was “elated” and was “looking forward to returning to the UK and getting back to what I love most: my family and innovating in my field”.

David Yelland, a communications adviser who worked with Lynch, said: “To think Mike Lynch might have lost his life just as he began to rebuild it is devastating for all those that know him. His entire life is one of beating the odds in the most extraordinary of situations, we must pray he does so again.” 

A spokesperson for Lynch declined to comment.

The Italian coast guard said Bayesian sank to a depth of approximately 50 metres off the coast of Palermo.

Giuseppe D’Agostino, mayor of Santa Flavia, a village on the coast close to where the vessel sank, said the search had not stopped. “The community is shaken. Everyone is helping,” he told the Financial Times.

“I spoke to some survivors. They are shocked. They didn’t have the strength to speak,” he added.

Another survivor was Charlotte Golunski, a partner at Lynch’s venture firm Invoke Capital, along with her husband James Emsilie and one-year-old daughter. She told Italian media that her family had left their cabin during the storm and headed for the deck.

Records indicate that Lynch’s family-owned the yacht. Bayesian is owned by Isle of Man-registered company Revtom Limited, according to shipping database Equasis. Isle of Man filings show that Bacares is the sole shareholder of Revtom.

The Sunday Times rich list estimated Lynch’s family fortune at £500mn earlier this year.

The name Bayesian is likely to be a reference to the 18th-century English statistician Thomas Bayes, whose theory of statistics informed the search technology behind Autonomy’s software.

The yacht had been anchored at the small Italian island of Panarea, according to MarineTraffic, a boat tracking site. It then passed through the Aeolian Islands on its way to Palermo before being hit by what has been described as a “tornado”.

Luca Cari, a spokesperson for the Italian fire department, said divers and other rescue workers had been working at the scene since Monday morning.

“We arrived when the ship had already sunk,” he said, adding that the operation was complicated by the depth to which the boat had sunk. Cari said the body had been recovered outside the shipwreck. He declined to identify the victim.

The UK’s Department for Transport said the UK’s Marine Accident Investigation Branch was deploying a team of four inspectors to Palermo to conduct a “preliminary assessment into the foundering”. The UK will lead the investigation because the vessel was flying the British flag.
