The 54m/177'2" motor yacht 'Fortunate Sun' (ex. Perfect Prescription) was built by Oceanfast in Australia at their Henderson, Western Australia shipyard. Her interior is styled by British designer design house Tim Heywood Design and she was delivered to her owner in July 2003. This luxury vessel's exterior design is the work of Tim Heywood Design and she was last refitted in 2008.

Guest Accommodation

Fortunate Sun has been designed to comfortably accommodate up to 10 guests in 5 suites. She is also capable of carrying up to 14 crew onboard to ensure a relaxed luxury yacht experience.

Range & Performance

Fortunate Sun is built with a steel hull and aluminium / grp superstructure, with teak decks. Powered by twin diesel MTU (12V 4000 M70) 12-cylinder 2,330hp engines, she comfortably cruises at 13 knots, reaches a maximum speed of 17 knots with a range of up to 5,758 nautical miles from her 140,000 litre fuel tanks. A Summary of Motor Yacht FORTUNATE SUN

The motor yacht FORTUNATE SUN is a 54 m 177 (ft) impressive steel vessel which was created at Oceanfast (Austal) and designed by Oceanfast and Tim Heywood. Sleeping 10 passengers and 12 qualified crew, motor yacht FORTUNATE SUN used to be Perfect Prescription which was her project name and/or yacht title. Ready for launch in 2003 the recent interior design reflects the endowment emanating from the boards of Tim Heywood.

M/Y FORTUNATE SUN (ex Perfect Prescription) was commissioned for a New Yorker in the pharmaceutical business. The motor yacht can be easily recognised with her grey hull and white superstructure.

The Building & Designing for Luxury Yacht FORTUNATE SUN

Oceanfast was the naval architect involved in the technical superyacht composition for FORTUNATE SUN. Her interior design was conceived by Tim Heywood. Oceanfast and Tim Heywood is also associated with the yacht general design work for this yacht. In 2003 she was actually launched with triumph in Fremantle and following sea trials and detailing was thereafter passed on to the yacht owner. Oceanfast (Austal) completed their new build motor yacht in Australia. The hull was constructed with steel. The motor yacht superstructure is fabricated largely from aluminiumandgrp. With a beam of 10.21 metres / 33.5 ft FORTUNATE SUN has spacious room. A fairly shallow draught of 2.74m (9ft) limits the number of worldwide marinas she can berth in, depending on their individual depth at low tide. She had refit maintenance and alteration work undertaken in 2008.

Installed with twin MTU diesel main engines, FORTUNATE SUN will attain a maximum speed of 18 knots. Connected to her MTU engine(s) are twin screw propellers. Her total HP is 4730 HP and her total Kilowatts are 3481. For bow thruster maneuverability she was built with Schottel.

PLEASE READ THESE TERMS AND CONDITIONS (“ Terms ”) CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS AS WELL AS A SECTION GOVERNING THE JURISDICTION AND VENUE OF DISPUTES. THESE TERMS ALSO CONTAIN A LEGALLY BINDING RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK. By creating a username, a login, clicking submit, using the services of Charter Experts, LLC d/b/a Virgin Island Sailing® (“ Broker ) or by accessing Broker’s website, you agree that you have read, and acknowledge your acceptance of these Terms. The Terms are subject to change at any time without notice at Broker’s sole discretion. Additionally, any transaction for which you have made payment shall be governed by the form of Terms in effect at the time of such payment notwithstanding any subsequent changes hereto.

If you are obtaining a quote, information, booking travel for and/or securing or procuring a Charter (as that term is defined in Section 1 below) for more than just yourself, all references below to “Charterer” or “you” (and derivations thereof) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote, information, booking travel for and/or securing or procuring Charter.

These Terms shall be read together and construed, to the fullest extent possible, to be in concert with any other agreement by or among Broker and Charterer. To the extent they cannot be so construed, then in the event of any direct conflict between these Terms and any other agreement by or among Broker and Charterer (including but not limited to the agreement executed by Charterer for a Charter Reservation (as that term is defined in Section 1 below), these Terms shall prevail.

  • Prepaid Charter Reservations . Typically, Broker negotiates charter rates in advance with the yacht owner or charter company (“ Charter Provider ”) to obtain cost-effective rates, and facilitate reservations and availability for yacht charters, excursions and travel (the “ Charter ”). Broker also provides services to you by facilitating the booking of reservations for consideration and receives a commission from the Charter Provider (the “ Broker Fee ”). The Broker Fee is included in the pre-negotiated Charter rate provided to you, plus taxes and other fees where applicable. You agree that your payment is for the total amount set forth in the applicable Charter agreement (which Charter Provider may refer to as a Charter Contract, Charter Agreement, Booking Terms & Conditions, Instructions and Terms for Accommodations, as well as other derivations) provided to you by Broker (“ Charter Agreement ”). Upon execution of the Charter Agreement and receipt of the applicable deposit, you will have made a reservation for the Charter that authorizes Broker to facilitate the Charter on your behalf (“Charter Reservation”), including making payment arrangements with the Charter Provider. You further agree that Broker is a third-party beneficiary to the Charter Agreement and shall have the right to enforce such agreement to the extent it deems such enforcement necessary or advisable to protect its rights hereunder or under the Charter Agreement.

  Broker retains the Broker Fee as compensation in arranging your Charter Reservation. The Broker Fee varies based on the amount and type of Charter and/or services provided by Broker.  By making a Charter Reservation, you accept and agree to the relevant cancellation and no-show policy of the Charter Provider set forth in the Charter Agreement. Cancellation and no-show policies vary for each Charter. Carefully read the Charter Agreement and additional information provided to you by Broker. It is expressly agreed by Charterer that the Broker Fee is earned at the time the Charter Reservation is made. Late payment, wrong credit card or debit card details, invalid credit or debit cards, or insufficient funds are for your own risk and account, and you will not be entitled to any refund of any prepaid amount unless the Charter Provider expressly agrees otherwise under the Charter Agreement or in some other signed writing.

  • Charter Rules and Restrictions . Additional terms and agreements will apply to your Charter Reservation and any purchase or rental of equipment or other items, supplies, provisions and travel you may select. Please read those additional terms carefully. In particular, if you have purchased airfare, please ensure that you read the full terms and conditions of carriage issued by the supplier. You agree to abide by the terms of purchase imposed by any supplier with whom you elect to deal, including but not limited to payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability, charges, fares, and use of products and services.
  • Payment . All payments must be made by personal check, bank/wire transfer, ACH payment and/or with a major credit card unless otherwise expressly stated. The total price for the Charter Reservation will be billed in U.S. Dollars unless otherwise stated. Some banks and credit card companies impose fees for international transactions. If you are making a reservation from outside of the United States on a US credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the amount provided by Broker for the Charter Reservation. In addition, a foreign transaction fee may be assessed if the financial institution that issued your credit card is located outside of the United States. Booking international travel may be considered to be an international transaction by the financial institution or card company. The currency exchange rate and foreign transaction fee is determined solely by your financial institution on the day that it processes the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your financial institution. Broker shall not be liable to you for any such service, conversion, or exchange fee.

  Broker expressly reserves the right to cancel your Charter Reservation if full payment is not timely received as set forth in the Charter Agreement.

  • Cancellation and Rescheduling . You may cancel or change your Charter Reservation as set forth in the Charter Agreement by and among you, the Charter Provider and/or Broker. Please note that some Charter Providers do not permit changes to or cancellation of reservations after they are made, or after a certain date, as indicated in the Charter Agreement. You agree to abide by the terms of the Charter Agreement with respect to your Charter Reservation. Broker will not be responsible for reimbursing Charterer for any previously tendered deposits or payments by Charterer and disclaims all liability for the failure of a Charter Provider to refund or return any such funds.
  • Credit Card Transactions and Chargebacks . If for any reason, any Charter Provider is unable to provide the Charter, or any part thereof, for which you have contracted, your remedy lies against the Charter Provider, and not against Broker. However, Broker will use reasonable efforts to assist you and Charter Provider in reaching a resolution to a dispute between you and the Charter Provider. In the event that your payment has already been transferred from Broker to Charter Provider or to an escrow account, you agree that you will not seek a chargeback against Broker for such amounts transferred. You further agree to indemnify and hold Broker harmless from and against any liability, loss, damage or expense (including without limitation, reasonable attorneys’ fees) that Broker may incur in connection with chargebacks against Broker or under the Charter Agreement and your performance thereunder. If Broker incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company or other financial institution, you agree that you will be liable for these costs. If your payment is declined for any reason, you agree to settle any amounts owed to Broker via money order, cashier’s check, personal check or bank/ACH transfer immediately.
  • Broker Responsibility . Broker makes arrangements with the Charter Provider. Broker additionally makes additional arrangements with other suppliers for the various components and other services that comprise your Charter (“Charter Suppliers”). Broker is not an agent of these Charter Providers or the Charter Suppliers (and the Charter Providers and Charter Suppliers are not agents of Broker). Broker expressly disclaims any liability for the actions or omissions of the Charter Provider and the Charter Suppliers. The Charter Providers and the Charter Suppliers reserve the right to refuse service to you at their sole discretion. Broker assumes no liability for the acts of the Charter Provider or the Charter Suppliers in refusing service. Broker is not responsible for schedule changes and does not offer compensation for those changes. Broker is not responsible under any circumstances for any injury or damages you may suffer, in connection with sea, air or ground transportation, hotel accommodations, or other travel or excursion services arranged by Broker.

  You understand Broker is not the source or supplier of the Charter or other travel services you requested and acts solely as a broker for the Charter Provider and the Charter Suppliers. You agree that the Charter Provider and Charter Suppliers whose names appear in the information supplied to you are those who are solely responsible for providing the Charter you purchase. You consent to and request the use of the Charter Provider and the Charter Suppliers and agree to not hold Broker responsible should any of them: (i) fail to provide the Charter or travel services you purchased, whether or not such services are listed in the Charter Agreement or otherwise, (ii) fail to comply with any applicable law, or (iii) engage in any negligent act or omission that causes you any sort of injury, damage, delay or inconvenience.

By using Broker’s services, you waive and release any claim against Broker, its affiliated and subsidiary companies, and their respective officers, directors, employees, contractors, and agents, arising out of or in connection with any loss of or damage to property or injury to any person caused by reason of (i) any defect, negligence, or other wrongful act or omission, or any failure of performance of any kind, by any Charter Provider, Charter Suppliers, or any other provider of sea, airline, hotel, ground transportation or any other travel provider connected to or otherwise associated with the Charter, (ii) any claim for inconvenience, loss of enjoyment, mental distress or other similar claim, (iii) any delayed departure, missed connection, substitute accommodation, termination of service or change in fares or rates, and (iv) overbooking, flight or other travel cancellation, lost or misconnected personal property, or any claim arising out of the air transportation portion of your travel, and (v) or any other claim arising out of or otherwise related to the Charter Agreement or services provided by the Charter Provider and the Charter Suppliers.

Excepting only liability that directly arises from the gross negligence or willful misconduct of Broker, you will not hold Broker responsible for any injury, damage or loss you may suffer while on a Charter, whether incurred on the Charter or in connection with any other rental, purchase, excursion or activity, regardless of the relationship of any of the foregoing with the Charter Provider or the Charter Suppliers.

  • Your Responsibility . By booking a Charter with Broker, you agree to defend and indemnify and hold harmless Broker, Charter Provider, Charter Suppliers, and each of their respective officers, directors, employees and agents, from and against any and all claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal fees, arising out of or in connection with: (i) your breach of these Terms or the documents referenced herein; (ii) your violation of any law or rights of a third party; or (iii) your use of the Broker website.

You will review your Charter Agreement and travel documents for accuracy upon receipt. You understand that it is your responsibility to review the accuracy of all details in the Charter Reservation provided to you, and that you may contact Broker if you have any questions.

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).

You understand that Broker recommends purchasing travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

  • No Warranties . All Charters, products, services, advice and information is provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied to the fullest extent permitted under the law, including but not limited to, warranties of title or implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made (i) regarding the acceptance of any reservation request or Charter Reservation; (ii) regarding the availability of Charters, or any other product and/or services through Broker; (iii) that the use of Broker’s website will be error-free; or (iv) regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided by Broker or through Broker’s website.

Broker has no special knowledge regarding the Charter Provider’s or Charter Supplier’s financial condition, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel during or otherwise in connection with your Charter.

  • Limitation on Liability . In no event shall Broker, Charter Provider, Charter Suppliers, and/or their respective affiliates, or any employees, agents, officers, directors, members or managers of any of the foregoing (“Broker and Charter Releasees”), be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use the Broker’s website, the Charter or services provided to you in connection with the Charter (including, but not limited to, your reliance upon opinions of the Broker), whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Broker and/or any other of the Broker and Charter Releasees have been advised of the possibility of such damages.

If, despite the limitation above, Broker or the Broker and Charter Releasees are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then Broker, Charter Provider, Charter Supplier and the Broker and Charter Releasees will in no event exceed, in the aggregate, the greater of (a) the Broker Fee, and (b) One-Hundred Dollars (US $100.00).

The foregoing limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose. The limitations of liability provided in these Terms inure to the benefit of Broker and/or its providers.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

  • Limitation on Time to File Claims . ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF RELATING TO BROKER’S SERVICES OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
  • Waiver . No waiver by Broker of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Broker to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
  • Severability . If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
  • Governing Law and Mandatory Venue . The laws of the State of Florida govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. You agree that any action or proceeding initiated by Charterer against Broker shall be brought solely in the federal and state courts of Hillsborough County, Florida, and you submit to the jurisdiction of those courts and waive any objections to the exercise of personal jurisdiction over you by those courts. In the event any action or proceeding is initiated by Charterer in a court outside of Hillsborough County, Florida, Charterer agrees to pay Broker’s costs and reasonable attorneys’ fees associated with defending such action or proceeding and waives any and all defenses to the transfer of said action or proceeding, whether jurisdictional or otherwise, to a federal or state court in Hillsborough County, Florida.

THE captain and crew of sunk superyacht Bayesian are facing a manslaughter and homicide probe after seven on board died including Brit tech tycoon Mike Lynch and his daughter.

Prosecutors disclosed that the victims had attempted to scramble to one side of the doomed £30million, 184ft vessel in a desperate battle to reach air pockets after it went down in a storm off Sicily.

Mr Lynch and four others were found in the first cabin of the luxury yacht’s left side while his 18-year-old daughter, Hannah, was alone in the third after it sank stern-first before rolling on to its right on the seabed. The yacht’s chef also died.

Fifteen of the 22 people on board, including Mr Lynch’s wife Angela Bacares, 57, escaped on a life raft.

Chief Prosecutor Ambrogio Cartosio said the victims would have been asleep when the freak weather struck at around 5am local time on Monday last week, leaving them unable to escape.

It was revealed that a downburst — a powerful, localised wind striking the boat — and not a tornado caused the disaster.

The victims’ bodies were wedged in “tight spots” with furniture on top of them, it was said — but a suggestion that the yacht’s hatches or windows may have been left open was not confirmed.

Divers made more than 120 trips in five days to the wrecked boat 164ft below the surface, with mirrors in the cabins making their tough job harder because their lights were reflected back at them.

It was also revealed that the crew and captain were not tested for alcohol or drug use after the sinking and have no legal requirement to stay in Sicily .

At the Termini Imerese Courthouse in Palermo, Mr Cartosio said there may have been “behaviours that were not perfectly in order with regard to the responsibility everybody had”.

He added: “There could be in fact the question of homicide. But this is the beginning of the inquiry, we cannot exclude anything at all.”

He said one line of inquiry was whether the crew attempted to raise the alarm with passengers before getting on the lifeboat and escaping.

He vowed to “discover how much they (the crew) knew and to what extent all the people (passengers) were warned.”

He said: “We will establish each element’s (crew) responsibility. For me, it is probable that offences were committed — that it could be a case of manslaughter.”

He said Captain James Cutfield had been “extremely cooperative” during questioning and will be quizzed further.

Lead prosecutor Raffaele Cammarano said Italy’s Air Force determined the boat was sunk by a downburst which descended from a thunderstorm.

He said there were forecasts of strong winds and a storm alert but good visibility and no suggestion of a tornado.

He added: “Given the conditions were such, there wasn’t anything to suggest there could be an extreme situation.

“There are vessels that can monitor  these events and one would have thought the captain had taken precautions.”

He said one person was on watch in the cockpit at the time of the accident.

Bentivoglio Fiandra, chief of Palermo’s fire brigade and part of the rescue, said the victims “were trying to hide in the cabins on the left-hand side” where the last air pockets remained.

With Mr Lynch in the first cabin were Morgan Stanley International chief Jonathan Bloomer and his wife Judy, and Clifford Chance lawyer Christopher Morvillo and his wife Neda .

The body of Hannah , in the third, was recovered on Friday by divers. Some were involved in the 2012 Costa Concordia rescue.

Giuseppe Frison, head of the Department of Fire Fighters’ Divers, said the Bayesian was “more intense” as the dives were deeper.

He added: “This event has brought back some memories.

“Inside the cabin, it revived the same sensations. But in terms of scale, everything was very different. Plus this dive was so much deeper, so we had to severely restrict our time at depth.

“It felt a little like re-running the movie in our heads. Although the scene was very similar, it was like visiting someone’s house turned at 90 degrees, with everything on its side.”

Vincenzo Nardoni, inspector at the Department of Fire Fighters’ Divers in Naples, added: “Inside it was a very confusing place, with wardrobes and furniture whirling all around us, and lots of mirrors reflecting back our lights at us.

“The bodies were all wedged in tight spots, with furniture on top or beside them. They were all stuck there.”

Giovanni Costantino, CEO of The ­Italian Sea Group, which manufactured Perini Navi shipyard vessel Bayesian, accused the crew of failing to “close the doors and hatches” and insisted the boat should have been “unsinkable”.

Meanwhile, the Bayesian’s chief stewardess, Sasha Murray, paid tribute to the Lynch family yesterday. She called Hannah “a diamond in a sea of stars; bright beautiful and always shining”.

Ms Murray, who it is understood was rescued from the yacht, added: “What most people may not have seen was the extraordinarily strong, deep and loving relationship she shared with her parents.”

The sailing trip to the Mediterranean, is understood to have been a celebration of Mr Lynch’s acquittal in a major US fraud trial.

The dad of two, who created software giant Autonomy, said he was “elated” to be cleared on June 6 with co-defendant Stephen Chamberlain, 52.

Mr Chamberlain, a finance executive, died in hospital after being hit by a car while out running near his home in Cambridgeshire on August 21.

Police said there was no suggestion his death was suspicious.

Bayesian mystery: the unanswered questions

PROSECUTORS confirmed they have launched a major probe into whether the Bayesian crew follow the right procedures before it tragically sank.

With the investigation underway now that bodies have been recovered, these are the key points that remain shrouded in mystery.

Why did it sink while other boats withstood the storm?

Survivors were saved by crew of Dutch boat Sir Robert Baden Powell, which was moored right near the Bayesian.

The 42-metre boat remained anchored after its skipper turned on the engine, also avoiding a collision with the doomed British-flagged vessel.

Captain Karsten Borner said the Bayesian crew were likely "surprised" by the storm's prowess.

Were proper safety precautions followed?

In light of the weather warning issued by the coast guard, questions have been raised over whether yacht guests were woken up and given life jackets.

On Saturday, prosecutors said those who died were likely asleep when the storm hit.

This meant they couldn't escape as the boat rapidly sank, investigators believe.

Was the Bayesian properly anchored?

The anchor being lowered to 50 metres has sparked questions over whether the yacht should have been secured in shallower water.

Retired Royal Navy Commander Tom Sharpe also said the Bayesian is designed for a huge sail - and without the sail raised, the fierce gusts would've rocked the boat's aluminium pole.

He told CBC News: "My kind of working assumption is that she was probably a bit further in at anchor, and it’s very likely, in these sort of conditions, that her anchor dragged."

Were hatches left open?

It access hatches were left open before the storm struck, it's believed the yacht would've quickly filled with water once it tipped, causing the swift sinking.

An expert at the scene told Reuters that one of the earliest aims for investigators was to establish whether the crew did not close access hatches before disaster struck.

With temperatures above 33 degrees, they may have been left open for air circulation.

Sam Jefferson said: "I imagine all the doors were open because it was hot, so there were enough hatches and doors open that it filled with water very quickly and sank like that."

How long will the investigation take?

Sicilian prosecutors wouldn't be drawn on giving a timeline for the investigation on Saturday.

With the wreck at 50 metres below the sea surface, they warned it would take some time.

Autopsies are also yet to be done.

John Fogerty and Doug Clifford both enlisted in the Army Reserves in 1966 (to avoid being drafted and shipped to Vietnam) and were discharged in 1968 after serving their military commitments. In 2016, Wrangler again turned to CCR to soundtrack a spot, this time using " Up Around the Bend ."

If you were drafted in 1966 you did not have the option to join the reserves you went directly on active duty for 2 years and had a 90% chance of going to Vietnam. George Bush and I were lieutenants and pilots in the 111th Fighter Interceptor Squadron (FIS), Texas Air National Guard (ANG) from 1970 to 1971. We had the same flight and squadron commanders (Maj. William Harris and Lt. Col. Jerry Killian, both now deceased). While we were not part of the same social circle outside the base, we were in the same fraternity of fighter pilots, and proudly wore the same squadron patch. It is quite frustrating to hear the daily cacophony from the left and Sen. John Kerry, Massachusetts Democrat, et al., about Lt. Bush escaping his military responsibilities by hiding in the Texas ANG. In the Air Guard during the Vietnam War, you were always subject to call-up, as many Air National Guardsmen are finding out today. If the 111th FIS and Lt. Bush did not go to Vietnam, blame President Johnson and Secretary of Defense Robert S. McNamara, not lowly Lt. Bush. They deliberately avoided use of the Guard and Reserves for domestic political calculations, knowing that a draftee only stirred up the concerns of one family, while a call-up got a whole community's attention. The mission of the 147th Fighter Group and its subordinate 111th FIS, Texas ANG, and the airplane it possessed, the F-102, was air defense. It was focused on defending the continental United States from Soviet nuclear bombers. The F-102 could not drop bombs and would have been useless in Vietnam. A pilot program using ANG volunteer pilots in F-102s (called Palace Alert) was scrapped quickly after the airplane proved to be unsuitable to the war effort. Ironically, Lt. Bush did inquire about this program but was advised by an ANG supervisor (Maj. Maurice Udell, retired) that he did not have the desired experience (500 hours) at the time and that the program was winding down and not accepting more volunteers. If you check the 111th FIS records of 1970-72 and any other ANG squadron, you will find other pilots excused for career obligations and conflicts. The Bush excusal in 1972 was further facilitated by a change in the unit's mission, from an operational fighter squadron to a training squadron with a new airplane, the F-101, which required that more pilots be available for full-time instructor duty rather than part-time traditional reservists with outside employment. The winding down of the Vietnam War in 1971 provided a flood of exiting active-duty pilots for these instructor jobs, making part-timers like Lt. Bush and me somewhat superfluous. There was a huge glut of pilots in the Air Force in 1972, and with no cockpits available to put them in, many were shoved into nonflying desk jobs. Any pilot could have left the Air Force or the Air Guard with ease after 1972 before his commitment was up because there just wasn't room for all of them anymore. Sadly, few of today's partisan pundits know anything about the environment of service in the Reserves in the 1970s. The image of a reservist at that time is of one who joined, went off for six months' basic training, then came back and drilled weekly or monthly at home, with two weeks of "summer camp." With the knowledge that Mr. Johnson and Mr. McNamara were not going to call out the Reserves, it did become a place of refuge for many wanting to avoid Vietnam. There was one big exception to this abusive use of the Guard to avoid the draft, and that was for those who wanted to fly, as pilots or crew members. Because of the training required, signing up for this duty meant up to 2½ years of active duty for training alone, plus a high probability of mobilization. A fighter-pilot candidate selected by the Guard (such as Lt. Bush and me) would be spending the next two years on active duty going through basic training (six weeks), flight training (one year), survival training (two weeks) and combat crew training for his aircraft (six to nine months), followed by local checkout (up to three more months) before he was even deemed combat-ready. Because the draft was just two years, you sure weren't getting out of duty being an Air Guard pilot. If the unit to which you were going back was an F-100, you were mobilized for Vietnam. Avoiding service? Yeah, tell that to those guys. The Bush critics do not comprehend the dangers of fighter aviation at any time or place, in Vietnam or at home, when they say other such pilots were risking their lives or even dying while Lt. Bush was in Texas. Our Texas ANG unit lost several planes right there in Houston during Lt. Bush's tenure, with fatalities. Just strapping on one of those obsolescing F-102s was risking one's life. Critics such as Mr. Kerry (who served in Vietnam, you know), Terry McAuliffe and Michael Moore (neither of whom served anywhere) say Lt. Bush abandoned his assignment as a jet fighter pilot without explanation or authorization and was AWOL from the Alabama Air Guard. Well, as for abandoning his assignment, this is untrue. Lt. Bush was excused for a period to take employment in Florida for a congressman and later in Alabama for a Senate campaign. Excusals for employment were common then and are now in the Air Guard, as pilots frequently are in career transitions, and most commanders (as I later was) are flexible in letting their charges take care of career affairs until they return or transfer to another unit near their new employment. Sometimes they will transfer temporarily to another unit to keep them on the active list until they can return home. The receiving unit often has little use for a transitory member, especially in a high-skills category like a pilot, because those slots usually are filled and, if not filled, would require extensive conversion training of up to six months, an unlikely option for a temporary hire. As a commander, I would put such "visitors" in some minor administrative post until they went back home. There even were a few instances when I was unaware that they were on my roster because the paperwork often lagged. Today, I can't even recall their names. If a Lt. Bush came into my unit to "pull drills" for a couple of months, I wouldn't be too involved with him because I would have a lot more important things on my table keeping the unit combat ready. Another frequent charge is that, as a member of the Texas ANG, Lt. Bush twice ignored or disobeyed lawful orders, first by refusing to report for a required physical in the year when drug testing first became part of the exam, and second by failing to report for duty at the disciplinary unit in Colorado to which he had been ordered. Well, here are the facts: First, there is no instance of Lt. BMedush disobeying lawful orders in reporting for a physical, as none would be given. Pilots are scheduled for their annual flight physicals in their birth month during that month's weekend drill assembly — the only time the clinic is open. In the Reserves, it is not uncommon to miss this deadline by a month or so for a variety of reasons: The clinic is closed that month for special training; the individual is out of town on civilian business; etc. If so, the pilot is grounded temporarily until he completes the physical. Also, the formal drug testing program was not instituted by the Air Force until the 1980s and is done randomly by lot, not as a special part of a flight physical, when one easily could abstain from drug use because of its date certain. Blood work is done, but to ensure a healthy pilot, not confront a drug user. Second, there was no such thing as a "disciplinary unit in Colorado" to which Lt. Bush had been ordered. The Air Reserve Personnel Center in Denver is a repository of the paperwork for those no longer assigned to a specific unit, such as retirees and transferees. Mine is there now, so I guess I'm "being disciplined." These "disciplinary units" just don't exist. Any discipline, if required, is handled within the local squadron, group or wing, administratively or judicially. Had there been such an infraction or court-martial action, there would be a record and a reflection in Lt. Bush's performance review and personnel folder. None exists, as was confirmed in The Washington Post in 2000. Finally, the Kerrys, Moores and McAuliffes are casting a terrible slander on those who served in the Guard, then and now. My Guard career parallels Lt. Bush's, except that I stayed on for 33 years. As a guardsman, I even got to serve in two campaigns. In the Cold War, the air defense of the United States was borne primarily by the Air National Guard, by such people as Lt. Bush and me and a lot of others. Six of those with whom I served in those years never made their 30th birthdays because they died in crashes flying air-defense missions. While most of America was sleeping and Mr. Kerry was playing antiwar games with Hanoi Jane Fonda, we were answering 3 a.m. scrambles for who knows what inbound threat over the Canadian subarctic, the cold North Atlantic and the shark-filled Gulf of Mexico. We were the pathfinders in showing that the Guard and Reserves could become reliable members of the first team in the total force, so proudly evidenced today in Afghanistan and Iraq. It didn't happen by accident. It happened because back at the nadir of Guard fortunes in the early '70s, a lot of volunteer guardsman showed they were ready and able to accept the responsibilities of soldier and citizen — then and now. Lt. Bush was a kid whose congressman father encouraged him to serve in the Air National Guard. We served proudly in the Guard. Would that Mr. Kerry encourage his children and the children of his colleague senators and congressmen to serve now in the Guard. In the fighter-pilot world, we have a phrase we use when things are starting to get out of hand and it's time to stop and reset before disaster strikes. We say, "Knock it off." So, Mr. Kerry and your friends who want to slander the Guard: Knock it off.

He says that "some people are born made to wave the star spangled flag," which I think refers to politicians. "It ain't me, I ain't no Senator's son... I ain't no fortunate one." "Some folks are born silver spoon in hand Well, they help themselves, yeah When the taxman comes to the door House looks a like a rummage sale." How the already rich get richer, yet evade having to pay like average citizens. "Some folks inherit star spangled eyes Yeah, when they send you down to war Well, when you ask them how much you should give Yeah, it's always more, more, more" Star spangled eyes are the idealistic politicians who supported the war and began the draft process, yet had no personal experience of knowledge of what was really happening in Vietnam. How much should you give? Could mean monetary contributions, but also those that volunteered to fight the war and still they instituted the draft to draw more men into fight. I did read that Fogerty wrote this song after hearing about the elaborate wedding of Nixon's daughter to another politically connected groom. It was extrememly elaborate and cost an extreme amount of money. This happened at a time when many men were dying as young men on the battlefield. The contrast between the rich (Nixon) and the poor (Vietnam troops, the rest of America grieving over their losses) is very prominent in this song...

While flying combat aircraft sounds all glamerous it's a dangerous business and many pilots die every year during training and in accidents. CLEARWATER, Fla. (WPEC) — A 50-foot yacht caught fire on Saturday in Florida's Clearwater Harbor.

The U.S. Coast Guard stated that a good Samaritan brought two boaters from the yacht to the Clearwater Harbor Marina to report the fire and meet emergency medical services.

After the fire was reported, the USCG and partners began to put the fire out.

No injuries have been reported at this time.

PASSENGERS on board the doomed Bayesian superyacht frantically scrambled for the last air pockets as the boat sank.

British tech mogul Mike Lynch and his 18-year-old daughter Hannah were among six people recovered after the luxury vessel sank near Porticello at about 5am local time on Monday.

The body of Canadian-Antiguan national Recaldo Thomas, who was working as a chef on the superyacht, was recovered at the scene on Monday.

Morgan Stanley International bank chairman Jonathan Bloomer, his wife Judy Bloomer, Clifford Chance lawyer Chris Morvillo and his wife Neda Morvillo were also recovered from the wreckage.

Prosecutors have since opened a manslaughter and shipwreck inquiry without naming any suspects.

On Saturday, they pieced together the horrifying final minutes on board the sinking £30million vessel.

And for the first time, emergency service workers and divers also discussed in full the complicated five-day rescue attempt that took place 160 feet below the waters near Porticello, Sicily .

Divers from the specialised fire brigade cave rescue team described in dramatic detail the extraordinary challenges they faced more than 50m below the surface.

The 30 divers were only allowed to visit the seafloor for 12-minute bursts, every day from sunrise until sunset.

A few of the divers were also participating in the doomed Costa Concordia liner's 2012 recovery.

The head of the Palermo fire department and member of the divers' rescue squad, Bentivoglio Fiandra, described how the Bayesian sank stern-first before rolling onto its right side.

He explained: "As a result, the victims sought refuge on the left side of the boat, where the last air pockets remained as the vessel was sinking."

In the first cabin on the left, the divers discovered five bodies; in the third chamber on the left, they discovered Hannah's.

The fact that everything was on its side in the boat required the divers to "recalibrate," Mr Fiandra said.

Rescuers also had to get used to debris floating around and mirrors reflecting their torch lights back at them.

He explained: "We had to revise the scene from a different angle from the way we'd normally see it, and that made everything more difficult.

"We entered the confined spaces, having already performed evaluations on the safe point to enter inside the yacht.

"We found the safest spot and got inside from there.

"But inside it was a very confusing place, with wardrobes and furniture whirling all around us, and lots of mirrors reflecting back our lights at us.

"The bodies were all wedged in tight spots, with furniture on top or beside them. They were all stuck there."

Giuseppe Frison, Head of the Department of the Fire Fighters' Divers, leading the cave divers, told the Daily Mail :

"It was like visiting someone's house turned at 90 degrees, with everything on its side.

"Since everything was revolving around us, we had to proceed slowly, first securing floating items for safety.

"We operated methodically, whether the spaces were large or small, searching everywhere until we found what we were looking for."

He added: "We were in a room full of debris, with a mixture of wooden furniture and other objects, but there was this new factor, as the space was full of mirrors, making it very disorientating, as you enter with the light on our heads, you seem to see yourself coming toward the boat, so it was very confusing."

YACHT PROBE

It comes as the captain and crew of sunk superyacht Bayesian are facing a manslaughter and homicide probe after seven on board died including Brit tech tycoon Mike Lynch and his daughter.

Chief Prosecutor Ambrogio Cartosio said the victims would have been asleep when the freak weather struck at around 5am local time on Monday last week, leaving them unable to escape.

It was also revealed that the crew and captain were not tested for alcohol or drug use after the sinking and have no legal requirement to stay in  Sicily .

At the Termini Imerese Courthouse in Palermo, Mr Cartosio said there may have been “behaviours that were not perfectly in order with regard to the responsibility everybody had”.

He added: “There could be in fact the question of homicide. But this is the beginning of the inquiry, we cannot exclude anything at all.”

Mr Cartosio added one line of inquiry was whether the crew attempted to raise the alarm with passengers before getting on the lifeboat and escaping.

He vowed to “discover how much they (the crew) knew and to what extent all the people (passengers) were warned.”

FRIGHTENING footage has emerged of a waterspout lashing the Italian coast on the same day the Bayesian sank.

The superyacht was ensnared by a "Black Swan" sea twister off Sicily and capsized, leading to tragedy for those on board.

Another waterspout is believed to be the culprit behind the Bayesian sinking .

It capsized and descended to its doom when the wild weather struck Porticello Harbour near Palermo in Sicily at around 5am on Monday.

Marine experts told  The Times  how the freak waterspout would have caused hefty damage to the £14million boat, causing it to plunge underwater.

Matthew Schanck, chairman of the Maritime Search and Rescue Council, said: "Looking at the extreme weather, if it was a waterspout, which it appears to be, it's what I would class as like a Black Swan event.

"And if the waterspout ends up dumping a load of that water on board the vessel, that’s going to cause significant damage."

Fifteen people managed to escape the sinking as they clung onto lifeboats, but others weren't as fortunate.

Five bodies have since been found , including tech tycoon Mike Lynch and daughter Hannah, as well as yacht chef Ricardo Thomas - though only four recovered and one remains missing.

Officials said some bodies were trapped by mattresses inside a cabin, La Repubblica reports.

A further pair of missing passengers were then discovered but are yet to be recovered from the sunken vessel, sources say.

The search has been made difficult by depth, with the wreck sitting on the seabead 50 metres below the surface.

Powerful water pressure at levels that deep has restricted divers to short 12-minute intervals scouring the debris.

Among the survivors is Mike Lynch's wife Angela Baceras, 57, who reportedly remained in a "state of shock" on Wednesday in a hotel near the site of the sinking.

The waterspout behind the Bayesian sinking is categorised as a "tornadic" waterspout.

These act in the same way as land tornadoes, causing paths of destruction.

They can form during severe thunderstorms with high winds, strong hail and dangerous lightning.

Divers recover 5 bodies from wrecked superyacht off sicily; 1 still missing.

PORTICELLO, Sicily (AP) — Divers searching the wreck of a superyacht that sank off Sicily found the bodies of five passengers Wednesday, leaving one still missing as questions intensified about why the vessel sank so quickly when a nearby sailboat remained largely unscathed.

Rescue crews brought four body bags ashore at Porticello. Salvatore Cocina, head of the Sicily civil protection agency, said a fifth body had been located. Divers on-scene said they would try to recover it on Thursday while continuing the search for the sixth.

The discovery made clear the operation to search the hull on the seabed 50 meters (164 feet) underwater had quickly turned into a recovery one, not a rescue, given the amount of time that had passed and with no signs of life over three days of searching.

The Bayesian, a 56-meter (184-foot) British-flagged yacht, went down in a storm early Monday as it was moored about a kilometer (a half-mile) offshore. Civil protection officials said they believed the ship was struck by a tornado over the water, known as a waterspout.

Fifteen people escaped in a lifeboat and were rescued by a nearby sailboat. The body of the ship’s chef, Recaldo Thomas of Antigua, was recovered Monday.

Thomas was born in Canada, according to his cousin David Isaac, but visited his parents’ homeland of Antigua as a child, and moved permanently to the tiny eastern Caribbean island in his early 20s. Italian officials previously listed Antigua and Canada as the nationality of people on board.

The fate of six missing passengers had driven the search effort, including British tech magnate Mike Lynch , his 18-year-old daughter and associates who had successfully defended him in a recent U.S. federal fraud trial.

Lynch’s spokesperson did not respond to a request for comment Wednesday.

Meanwhile, Termini Imerese Public Prosecutor’s Office investigators were acquiring evidence for their criminal investigation, which they opened immediately after the tragedy despite no formal suspects having been publicly identified.

Questions have abounded about what caused the superyacht, built in 2008 by Italian shipyard Perini Navi, to rapidly sink, when the nearby Sir Robert Baden Powell sailboat was largely spared and managed to rescue the survivors.

Giovanni Costantino, head of The Italian Sea Group, which owns the ship maker, blamed human error for the disaster, which he said took 16 minutes. “The ship sank because it took on water. From where, the investigators will say,” he told RAI state television after he met with prosecutors.

Costantino cited AIS ship tracking data which he said showed the Bayesian had taken on water for four minutes when a sudden gust of wind flipped it and it continued taking on water. The ship straightened up slightly and then went down, he said.

But was it merely the case of a freak waterspout that knocked the ship to its side and allowed water to pour in through open hatches? What was the position of the keel, which on a large sailboat like the Bayesian might have been retractable to allow it to enter shallower ports?

“There’s a lot of uncertainty as to whether it had a lifting keel and whether it might have been up,” said Jean-Baptiste Souppez, a fellow of the Royal Institute of Naval Architects and the editor of the Journal of Sailing Technology. “But if it had, then that would reduce the amount of stability that the vessel had, and therefore made it easier for it to roll over on its side,” he said in an interview.

The captain of the sailboat that rescued survivors said his craft sustained minimal damage — the frame of a sun awning broke — even with winds that he estimated reached 12 on the Beaufort wind scale, which is the highest hurricane-strength force on the scale.

He said he had remained anchored with his engines running to try to maintain the ship’s position as the forecast storm rolled in.

“Another possibility is to heave anchor before the storm and to run downwind at open sea,” Karsten Borner said in a text message. But he said that might not have been possible for the Bayesian, given its trademark 75-meter (246-foot) tall mast.

“If there was a stability problem, caused by the extremely tall mast, it would not have been better at open sea,” he said.

Yachts like the Bayesian are required to have watertight, sub-compartments that are specifically designed to prevent a rapid, catastrophic sinking even when some parts fill with water.

The underwater search continued in dangerous and time-consuming conditions. Because of the wreck’s depth, which requires special precautions, divers working in pairs could only spend about 12 minutes at a time searching, though reinforcements outfitted with special equipment to enable longer dives were on the wreck Wednesday.

In all, some 27 divers took rotations, including four who helped with recovery after the 2012 Costa Concordia disaster off Tuscany. They called the Porticello wreck a “little Concordia,” fire crews said in a statement.

The limited dive time was aimed in part at avoiding decompression sickness, also known as the “bends,” which can occur when divers stay underwater for long periods and ascend too quickly, allowing nitrogen gas dissolved in the blood to form bubbles.

“The longer you stay, the slower your ascent has to be,” said Simon Rogerson, the editor of SCUBA magazine. He said the tight turnaround time suggested the operation’s managers were trying to limit the risks and recovery time after each dive.

“It sounds like they’re operating essentially on no decompression or very tight decompression, or they’re being extremely conservative,” he said.

Divers were also working with debris floating around them, limited visibility and air tanks on their backs.

“We are trying to advance in tight spaces, but any single thing slows us down,” said Luca Cari, spokesman for the fire rescue service. “An electric panel could set us back for five hours. These aren’t normal conditions. We’re at the limit of possibility.”

Lucky grocery store has its ups and downs. Their weekly specials are decent and can help you save, which is a positive. However, when compared to Safeway, I find that Lucky falls a bit short. Safeway's "five dollar Friday" deals and superior deli section really set it apart. Lucky is fine if you're in a hurry and need essentials, but if you're looking for more enticing deals and a wider range of deli options, you might want to stick with Safeway for a more satisfying shopping experience.

Horrible experience with the main baker there, she is the most rudest person i have ever met, if you do not believe go there and find out for yourself. I own a bakery myself and i rarely leave comments her name is Maria that is what she told me so I am Not sure

Been going to this store on and off for 15+ years. Customer service is usually good. They push the self checkout which is a pet peeve of mine but most stores do it. The last year or so I've noticed alot of expired food at this location. It's frustrating to have to check every label before purchase or have a nasty surprise when you get home. Its not just one department.. so check all your items before purchasing. Also heard 2 of the bakery team members complaining about aphids in the department.

This is the same supermarket chain that once had a store where Best Buy is now at El Camino and Bernardo, which closed permanently after hackers attached skimmers on the self service credit card reading machines, stealing and reusing hundreds of customer's credit card numbers. Rarely go to either the Luckys on Mathilda Ave, nor the one on El Camino Real next to the Fish Market, as Sprouts, Safeway, Trader Joe's, Target and Smart & Final closer and within walking distance of my house. I can tell when I've driven my car by looking at my credit card statements at purchases at Grocery Outlets or Lucky supermarkets, as those are the only times I need to drive my car, during the shelter-in-place era. April 8, Wednesday they had the weekly start of a sale on Atlantic salmon at $6.99 a pound, not quite as good as their previous Friday-Saturday-Sunday sales of whole fillets of Salmon at $5.99 a pound in late March. Heard that men have a 50% higher coronavirus death rate than women, so asked my wife to go to Lucky Thursday. Also she's an 'O' blood type, the least susceptible to the virus. No use in me playing Russian roulette with the virus, as I'm a 65+ male with underlying conditions, three strikes against me. She checked the specials, including the $1.67 for 6 ounce blackberries and raspberries. Told by the experts that the best time to do shopping during the pandemic is when stores first open, as fewest customers and fewest potential coronavirus carriers around. Wife interrupted her beauty rest, to get up at 7am. Luckys opens 6am-9am Tuesday and Thursday for seniors 65+, the disabled, and medical front line workers. Choice between Mathilda or El Camino Real. Last time she went to the Mathilda store, 2 miles but 11 traffic signals away, they were out of salmon, and it's in the sketchy part of town, with higher incidence of covid-19 cases. So she drives to El Camino Real, 3 miles away, 14 traffic signals, but bigger, cleaner, better lighting, with wider aisles, and more parking than the Mathilda store. The good thing is that our 2017 Honda Fit, loaded with battery draining electronics and computer, started instantly, for the first drive in 28 days. That was the last good thing that happened. 20 minutes later wife is back, totally pissed, vowing never to go to Luckys again. Had to come back Tuesday at 4pm, driving our 2017 Honda Civic for the first time in 21 days, to get the raspberries, blackberries, strawberries, and salmon, but by then huge line at the only open checkout stand, while 5 other checkout stands not in use.
