WHAT YOU NEED TO KNOW

As a yacht owner or captain, with responsibility for crew members, there are some issues you need to be aware of.

A key part of the Maritime labour Convention is that all seafarer employees will be subject to periodic inspections to ensure compliance. Accodingly, it is imperative that the employment of crew takes place in a manner that is fully MLC compliant and in line with legal requirements.

EU regulation EC/883/2004 which regulates social security contributions for mariners employed on EU flagged yachts, requires seafarers who are residents of the EU/EEA/Switzerland(citizens or not) employed on an EU flagged yacht must be insured according to the law of the EU flag State, and in that State.

The only exception lies in the case where employer and employee reside in the same Member State; the seafarer must be affiliated in that State for social security.

SOCIAL SECURITY CONTRIBUTIONS

Our team are maritime employment specialists who can ensure full compliance with the applicable employment legislation and EU social security requirements for crew employed on Maltese flagged yachts.

In order to address crew employment issues we have implemented the most practical and cost effective solution, now used by several of the worlds most prestigious superyachts (private and commercial) that fly the Malta Flag.

The Crew services structure has been developed with substantial tax and legal advice and is designed to employ seafarers and pay social security contributions in Malta. Our team will look after the following:

• Register the employer as well as the crew members for social security in Malta • Prepare the MLC/EU compliant seafarer employment agreements • Make monthly social security payments as well as compiling and filing the required employment forms • Effect salary payments to the crew members • Maintain the payroll • Ensure continued compliance with social security legislation as it evolves • Register and administer the Yachts Malta Flag Registration

The solution works perfectly for both employers and seafarers, the set up procedure is straightforward and all administration work is catered for by our team.

THE BENEFITS OF PAYING SOCIAL SECURITY IN MALTA

Yacht owners whose crew members are employed on Maltese flagged yachts and who are eligible to pay social security contributions in Malta will benefit from the following:

• Rate of social security contributions is very reasonable compared to other equivalent options. • Cost of running the structure is very competitive. • Crew members will be issued with a letter issued by the Maltese authorities which is equivalent to the social security card. • Persons insured in Malta may benefit from a European Health Insurance Card (EHIC) • Persons insured in Malta may benefit from an S1 form if they reside in a Member State other than Malta (on presentation of the salary slips showing the contributions) • Seafarers can also obtain the U1 form to claim unemployment benefits in their country of residence (request possible online) • Regarding the pension aspect, each state pays a rate of benefit which reflects the length of the claimant’s insurance in their scheme; this applies anywhere in the EU, EEA, and Switzerland; a person who has worked for more than one year in two or more of the above-mentioned states will be paid a pension proportional to the periods in these states.

There are no restrictions on the nationality of the master, officers and crew engaged on Maltese yachts and superyachts. A commercially registered superyacht of more than 24 metres in length will be issued with a Minimum Safe Manning Certificate following receipt and review of the application for a safe manning document. Commercial yachts of not more than 24 metres in length are not issued with a Minimum Safe Manning Certificate however, shall comply with the minimum manning requirements as set in the Commercial Yacht Code. Foreign certificates issued in terms of the STCW 78 Convention (as amended), require an endorsement issued by the Maltese Administration attesting their recognition. On case by case basis other yacht certification may be accepted.

Social Security for Yacht Crew Working on Malta Registered Yachts

Introduction.

It is the purpose of this guide to outline the social security obligations of both employer and employee in respect of yacht crew working onboard Malta registered yachts.

The Malta flag has become one of the most popular European flags for yachts of all sizes and through the Oceanskies office in Malta we register many vessels each year with Transport Malta who are the Maltese vessel registration authority.

Obligations for EU resident seafarers

All EU national and resident seafarers working on a Malta registered yacht must be registered with Department of Social Security in Malta unless already contributing to another EU social security regime (an exemption will have to be applied for, in writing with supporting evidence of the payment of social security contributions in another member state).

For the majority of crew members the social security contribution rates per Monday worked paid by the employer capped in 2024 will be 53.23 Euros for the seafarer (previously 51.60 Euros) and 53.23 Euros for the employer (previously 51.60 Euros).

Maternity contributions are due to be covered by the employer and for the majority are capped at 1.60 Euros.

Benefits of contributing to the Malta Social Security Scheme

1. A European Health Insurance Card offered to those insured in Malta and residing in a Member State other than Malta;

2. Unemployment benefits in the seafarer’s country of residence, claimable following the completion of a U1 form;

3. Pension secured at a rate of benefit reflecting the length of the claimant’s insurance in their scheme paid by any EU, EEA state and Switzerland; and

4. Protection from the repercussions of the French Decree 2017/307 by means of mandatory returns and payments on social security, amongst others.

Employment of Crew through non EU (offshore) yacht owning or employment / payroll company

Employment of crew through a non EU company (i.e. Guernsey, BVI etc.) does not in any way avoid the responsibility of both the employer and the yacht crew member to make social security contributions in Malta.

Yacht crew members who are employed by a non EU company who are not making social security contributions to the Malta Department of Social Security need to take action and should contact us for further assistance.

French social security decree for seafarers

The Government of France have enacted legislation designed to ensure that seafarers working on French flagged vessels as well as seafarers residing in France are provided with adequate social security protection in line with MLC 2006.

French social security obligations for Yacht Crew working onboard yachts flying the French flag or residing in France

Payment of social security obligations in Malta by both employer and employee for yacht crew established in France is complies both with Article 11.4 of EU Regulation 883/2004 (which deals with social insurance liability with regards EU nationals who are resident in an EU Member State and working on board vessels flying the flag of a Member State) and the new French legislation.

The OCL Malta Yacht Crew Employment Service

OCL is registered as an employer with the Malta Inland Revenue Department and, as such, is able to register the yacht crew that it employs with the Malta Department of Social Security and arrange for the payment of social security contributions.

Crew members who are registered will be issued with an S1 Certificate (healthcare cover certificate) and A1 Certificate (social security cover).

Fees for employing seafarers through OCL are as follows (per crew member, in EUROS or currency equivalent):

- Establishment of payroll
- Provision of crew contracts of employment / Seafarers Employment Agreement

Malta Yacht Registration

As a result of the clear framework provided by the Malta social security system we have transferred the registration of a significant number of yachts to the Malta register of ships including a number of yachts that are based in France so that their crew can be enrolled into the Malta social security system as an alternative to the ENIM system implemented by the French authorities.

Today Malta is the largest EU register for both ships and yachts and provides many other benefits as a high quality EU register of yachts and the jurisdiction provides yacht owners with other fiscal advantages.

Home: Inside the star yacht of Below Deck Mediterranean season seven

Television network Bravo has confirmed the return of Below Deck spin-off Below Deck Mediterranean as the seventh season wraps up filming in Malta. The hit reality series, which follows a yacht crew over an eight-week charter season, will premiere its new season on July 11 with Captain Sandy Yawn at the helm of an all-new yacht named Home . Take a look inside...

The 50 metre Home was built by Dutch shipyard Heesen in 2017 as a 'home away from home' for her owner. It was one of the first superyachts of its size to feature a hybrid propulsion package, which makes her 48 per cent more efficient than other 50 metre yachts, and is the first diesel-electric motor yacht to appear on Below Deck .

The yacht was started on speculation and construction was already underway when her owner joined the project. Home 's lines were designed by Frank Laupman of Omega Architects and inspired by another Heesen build, the 50 metre Sibelle . A vertical bow serves a dual purpose, helping the yacht to carve through waves, but also creating more room on the interior to place the crew accommodation. In order to stay under 500GT, Omega created walkaround decks with cut-out bulwarks that offer uninterrupted sea views from each of her two lounges.

The interior was started on spec but wasn't to the tastes of the owner, who brought in designer Cristiano Gatto to rework the design. The new brief was for a modern, comfortable interior; the keyword was simplicity, not minimalism. 

Home can sleep up to 12 guests in six cabins: a full-beam master suite can be found on the main deck, while a full-beam VIP cabin, two double cabins and two twins are found on the deck below. The decor takes inspiration from the owner's on-shore properties with a contemporary, "Ibiza-style" feel. Low-slung sofas are featured throughout with a palette comprised of white, black, grey and a deep red.

The sun deck will be a popular spot with guests during the series. There's a sit-up bar shaded by a hard top as well as a Jacuzzi and a dancing pole. A quartet of sun loungers can be found aft with yoga mats tucked underneath, while a projector and a screen set-up can transform the deck into an outdoor cinema. 

Another spot for riotous evenings is the sky lounge, which in effect is an extension of the outside deck with beanbags, day beds and teak flooring. The space is serviced by a bar and is a popular spot for lounging in the cool air and taking in the view. Alternatively, the doors to the aft deck can be shut, the furniture removed, a mirror ball and a smoke machine can be added and the area becomes a dedicated party room.

More fun can be found on Home ’s foredeck, in a telescopic seat that rises from the bow, allowing uninterrupted 360-degree views. It can even be used underway if the conditions are right. 

Captain Sandy will be joined by returning Below Deck cast member and deckhand Mzi “Zee” Dempers, as well as a trio of new department heads.

Bravo's much-beloved maritime hit has been seen filming in Malta for season 7 of Below Deck Mediterranean, with crew members spotted aboard superyacht HOME  and our exclusive superyacht data tracking her whereabouts confirms that she will be the new superyacht for this upcoming season.

Fans of the extremely popular reality TV show, which chronicles the lives of crew members working aboard a superyacht, will be extremely happy to hear the long-standing Captain will be back at the helm in the eagerly awaited new season.

Photos appear to confirm that fan favorite Captain Sandy will be returning to our screens as will Courtney Veale and Mzi "Zee" Dempers. It's expected season 7 will be aired in May 2022, but no official announcement has yet been made regarding its release nor the yacht and crew members.

Four Yacht Victims Likely Died After Depleting Air Pocket In Sunken Italian Ship: Reports

Four of the seven people killed when a luxury yacht sank off Italy’s coast last month likely died after depleting a pocket of air they had found while trapped inside the submerged ship, according to several reports.

Autopsies found that the victims — Morgan Stanley International chairman Jonathan Bloomer, his wife Judith, lawyer Chris Morvillo and his wife Neda — likely died from suffocation following the Aug. 19 sinking, Reuters reported Thursday citing judicial sources.

None of these four victims, who were found in the same cabin, had water in their lungs, suggesting they didn’t drown, the BBC also reported citing Italian news agency Ansa.

This type of death was described as “dry drowning,” which is when all of the available oxygen is consumed, leaving only carbon dioxide, CNN similarly reported citing local media.

The autopsies of two of the other victims, British tech star Mike Lynch and his 18-year-old daughter, are expected to take place on Friday. The autopsy of the ship’s onboard chef, Recaldo Thomas, has been delayed pending contact with his family in Antigua, CNN reported.

The 184-foot British-flagged ship was carrying 22 people when it was hit by a violent storm while anchored off the coast of Sicily in the early morning hours, causing it to capsize and sink within minutes, authorities previously said.

Of those on board, 15 were rescued by the Italian Coast Guard. The survivors included Lynch’s wife, Angela Bacares, who Reuters previously reported owns the firm that the yacht is listed under.

The group had been celebrating Lynch’s recent acquittal of fraud and conspiracy charges related to the $11 billion acquisition of his software maker Autonomy to Hewlett Packard in 2011, survivors have said.

An investigation remains underway into the cause of the ship’s sinking, including whether it was caused by human error.

Ritz-Carlton’s Ilma Sets Sail on Maiden Cruise

The Ilma officially kicked off its maiden season for The Ritz-Carlton Yacht Collection earlier this week.

After being delivered by the Chantiers de l’Atlantique shipyard in mid-July , the 456-guest vessel received its first paying guests on Sep. 2, 2024.

On that day, the Ilma departed from Monaco for a seven-night cruise to France and Italy that is set to end in Rome.

The open-jaw itinerary features visits to Cannes, Saint Tropez, Livorno, Bastia and Porto Cervo, as well as Monte Carlo and Civitavecchia.

During its maiden season, the LNG-powered ship then offers a series of seven- to 12-night cruises to the Mediterranean, the Adriatic, and the Aegean.

Extending through late October, the program also features departures from Piraeus, Barcelona and Civitavecchia.

In November, the Ilma arrives in the Caribbean for a winter cruise season that features sailings from San Juan, Fort Lauderdale, and Bridgetown.

For its first cruise in the region, the ship offers a six-night itinerary departing from Puerto Rico that includes ports of call in St. Lucia, Guadeloupe, Antigua and the British Virgin Islands.

Before receiving its first guests earlier this week, the Ilma operated training voyages across the Mediterranean .

With over 350 crew members onboard, the 37,000-ton vessel underwent a series of preparations during the period while visiting ports in France, Portugal, Malta and more.

Debuting a new design, the Ilma became the largest ship in the fleet for The Ritz-Carlton Yacht Collection, which also includes the 298-guest Evrima.

Currently under construction for the brand at the Chantiers de l’Atlantique Shipyard, the Luminara is also set to join the company’s fleet.

A sister to the Ilma, the vessel is scheduled to enter service in July 2025 ahead of an inaugural season in Europe.

The Luminara then marks Ritz-Carlton’s debut in Asia , offering ten new itineraries in the region between December 2025 and May 2026.

Rescued yacht crew return safely to Sydney

Two people stranded at sea off the New South Wales coat have safely returned to Sydney.

It comes after a daring multi-agency rescue operation.

The 19-metre yacht they were on ran into trouble in rough weather a long way off the South Coast.
